    Police departments throughout one state with a huge illegal immigrant population are uniting to reject immigration enforcement with the chief in one major county starring in commercials assuring those in the country illegally not to be afraid of police.

    Local law enforcement agencies throughout Maryland say immigration policy isn’t their business and, with the exception of one county sheriff’s department, they refuse to cooperate with federal authorities regarding the matter. The Frederick County Sheriff’s Department is the state’s only local law enforcement agency to sign an agreement with U.S. Immigration and Customs Enforcement to check the immigration status of arrestees.

    The others refuse, saying that immigration is a federal matter. The police chief in the jurisdiction with the state’s largest immigrant population, Montgomery County, even appears in public service commercials with a Bolivian soccer player to inform the community of the department’s hands off immigration policy. In the advertisement, Chief J. Thomas Manger tells illegal immigrants: “Don’t be afraid to call the police.â€

    so does this mean that since immigration is a federal law, that local police cant enforce the federal law of robbing banks or anything like that?

    james, that's EXACTLY how I read it too. Local police should not be able to pick federal laws to comply with. It's either all laws or none. Maryland is a stupid state, and when they inundated with 38 million illegals, it will be a little, too late for them to do anything.

    That is what cops in Houston say too. Even after having Officer Johnson shot in the back of the head by an illegal, previously deported.

    I wish Maryland would advertise this policy in Texas. Maybe a few million more would move north.

    The Common Claim that Illegal Immigration is a Federal Dilemma:

    An "urban legend" that has unfortunately been widely disseminated holds that states and local jurisdictions cannot tackle the problem of illegal immigration, since it is solely under federal control. Legislators and members of the public cling to this legend when confronted with the enormous consequences of unchecked illegal immigration. This allegation is entirely false.

    Undeniably, the United States Congress has ultimate and prevailing authority over immigration. U.S. Const., Art. 1, §8, Cl. 4. Furthermore, it is accurate that any state legislation or local ordinance that conflicts with or contradicts federal statutes is preempted by the Supremacy Clause. U.S. Const., Art IV, Cl. 2. However, the Immigration Reform and Control Act (IRCA), enacted by Congress in 1986, expressly delineates aspects of illegal immigration that can be targeted. Pursuant to 8 U.S.C. §1324a(h)(2), states and localities are not preempted from enforcing "licensing or other similar laws" targeting the rampant illegal immigration crisis.

    IRLI has been advocating that states and local jurisdictions are not preempted in the above-mentioned areas and this reasoning was affirmed by two federal judges discussed above (Arizona and Missouri federal victories). These findings should further embolden states and local jurisdictions that they have viable options to target the illegal immigration problem since the federal government is choosing not to enforce its law. States and localities can and should take matters into their own hands.
