ACLU Sues Federal Government For Detaining Illegal Aliens

To be clear, being in the United States without permission is a crime. Liberals try to confuse this inconvenient fact by calling illegal aliens “immigrants” and “new Americans,” but make no mistake, these people are breaking the law. The American Civil Liberties Union (ACLU) not only won’t acknowledge the fact that these people are criminals, they also seem to think that they have the same rights as American citizens. The faux civil rights group is actually suing the federal government for detaining illegal aliens.

The ACLU of San Diego and Imperial Counties is suing the federal government for allegedly depriving immigrants of their due process rights by detaining them for months before giving them an opportunity to see an immigration judge.
People charged with crimes usually get to see a judge within 48 hours, while immigrant detainees who have not committed crimes are routinely held upwards of two months before they get a court hearing, said Bardis Vakili, senior staff attorney for San Diego’s ACLU.
The federal government doesn’t detain “immigrants” it arrests illegal aliens. Also, as I just pointed out, being in this country without permission is a crime. It’s astounding that the ACLU can’t grasps these simple facts, yet thinks it has the legal standing to sue the government for enforcing existing Constitutionally sound laws.
The lawsuit, announced Friday and filed in federal court against the Department of Homeland Security and the Department of Justice on Thursday, seeks to end the practice of long detentions prior to immigration hearings.
“If the government is going to deprive someone of their liberty, they need to be given some fair process. And locking them up and throwing away the key for two or three months or longer is hardly a fair process,” said Vakili.
Incarcerating someone for two months is not “locking them up and throwing away the key.” That’s actually not that long of a detention, considering how many illegal aliens there are clogging up the court system, which by the way is a problem the law breakers have created.
Missing from this argument is the obvious point that none of these illegal aliens are being detained against their will. They are chosing detention rather than going back to their home countries. Each and every one of them, except those charged with additional crimes in the US, has the option to self-deport. They would rather be in detention, hoping for some kind of technicality or loophole that will allow them to stay in America.
Another missing point here is that illegal aliens don’t have the same rights as American citizens. The enumerated and protected rights of the Constitution apply to US citizens not foreign nationals who have snuck into the country. Illegal aliens can’t vote, own a gun, work for the government, or assemble. Well, they aren’t supposed to do those things but democrats turn a blind eye when they do. The point is, the Bill of Rights doesn’t extend to non-citizens.
Illegal alines have basic human rights and the Supreme Court ruled that they also have a right to due process. Neither the Constitution nor the Supreme Court however says that they have a right to see a judge within 48 hours like the ACLU claims.
Unshockingly, this ACLU lawsuit has less to do with the illegal alien detention system, that is the same as it was under Obama, and more to do with the liberal hysterical reaction to Donald Trump’s presidency:
Vakili said the ACLU expects the duration of detentions to increase under President Trump as his administration ends catch and release policies and detains a rising number of immigrants.
“With the rhetoric that the administration is going to focus on detention and essentially default to detention decisions … the situation will get a lot worse if the court doesn’t step in now and say there’s a requirement here that you must present them quickly to a judge,” Vakili said.
There is nothing about the lawsuit that isn’t deceptive, but the fact that they are motivated in filing it because of something that might happen because of Trump makes it extra stinky.
They didn’t sue when Obama was president and they aren’t suing because anything is different now. They aren’t even suing because of something Trump did, but rather something he might do.
