Illegal immigrants are beginning to find lawyers to plead their cases much easier under the Obama administration. This administration provides attorneys incentives to take on illegal clients pro bono through programs created by the federal government.
According to the Executive Office for Immigration Review, in 2013, 54 percent of those in illegal immigration proceedings had representation. This has significantly increased from 2009, when only 39 percent obtained attorneys.
The National Journal investigated this spike, and found the federal government has implemented incentives for attorneys to provide pro bono services to these illegal immigrants, with the hope that they win their cases.
The infamous Department of Health and Human Services provides pro bono representation to illegal juveniles, and helps custodians of undocumented children find attorneys.
Immigration procedures have changed since President Obama took office in 2009. In 2011, then-director of Immigration and Customs Enforcement John Morton, instructed officials to be more lax on illegal immigrants, especially if they had lived in the U.S. for a significant period of time.
The Obama administration’s Deferred Action for Childhood Arrivals also allows juveniles to delay deportation proceedings, which stretches these immigration cases out for years.
As a result of the Obama administration’s immigration policies, illegal immigrants are beginning to establish a “kind of a savvier understanding of what their rights might be,” said Crystal Williams, executive director of the American Immigration Lawyers Association.
Because immigrants are becoming more savvy in U.S. immigration policy, more have obtained lawyers, cases have become longer, and therefore, fewer deportations are processed. From 2009 to 2013, deportations dropped by 43 percent, and today, nearly 50 percent of illegal immigrants win their court cases.
