10 states allow undocumented immigrants to pay in-state college tuition

In-state college tuition for illegal migrants


Ten states, including California and Texas, have passed laws allowing undocumented immigrants who graduate from high schools to pay in-state tuition to attend college.

A small percentage of undocumented immigrant students in those states were attending college before the laws were passed, said Josh Bernstein, director of federal policy for the National Immigration Law Center. Now the number attending college has grown significantly in those states, but the majority of undocumented immigrant high school students still do not go on to college, he said.



If the DREAM Act passes, Bernstein expects even more will pursue higher education, in part because they would be able to work legally with the degree they earn. Because those states allow students who lack legal residency to pay in-state tuition, federal law requires that legal residents who graduate from high school in those states but then move outside of them be allowed to attend their public colleges for the price of in-state tuition.
