Man gets five years for statutory sodomy, child molestation in St. Charles

ST. CHARLES • Samuel Hernandez-Herrera, 45, of the 3000 block of Flamingo Drive in St. Charles, was sentenced today to five years in prison for having sexual contact with a girl and a boy, both younger than 14, between 2008 and 2010, prosecutors said.

Hernandez-Herrera pleaded guilty today on one count of statutory sodomy and two counts of child molestation. The maximum penalty would have been life in prison for the statutory sodomy charge and 15 years in prison on each of the child molestation charges.

Circuit Judge Nancy Schneider upheld the terms of a plea agreement by sentencing Hernandez-Herrera to concurrent terms of five years in prison on each count, prosecutors said.

St. Charles County Prosecutor Jack Banas said Hernandez-Herrera is in the country illegally, and immigration officials will deport him after he is released from prison.

Assistant prosecutor Rebecca Shaffar represented the state. Assistant public defender Tracy Brown represented Hernandez-Herrera.
