McALLEN — A man shot by police after allegedly trying to attack officers with a knife was formally charged on Friday.
Carlos Humberto Esquivel, 47, was formally charged on four counts of aggravated assault of a peace officer and one count of assault.
Bond was set at $415,000.
Aggravated assault of a peace officer is a first degree felony punishable by up to life in prison. Assault is a misdemeanor punishable by up to a year in jail and a maximum $4,000 fine.
The officer-related shooting occurred on the 900 block of Redwood Avenue on Jan. 30, when McAllen police officer Richard Villarreal fired one shot into Esquivel's abdomen when he refused to put down two butcher knifes while charging toward officers, police said.
McAllen investigators determined Villarreal was right to use deadly force against Esquivel. The case will be turned over to the Hidalgo County District Attorney's Office, which will present it before a grand jury.
Police said Esquivel is a Guatemalan national previously deported after arrests on drug and assault charges.
