    A suspected illegal immigrant accused of hitting and killing 74-year-old Beverly Duffield on her bike this week has prior arrests.

    City of Tulsa records show 28-year-old Roberto Alvelais-Torres has been arrested at least twice before this week’s arrest.

    FOX23 broke this story first at 6:00pm on FOX23.com.

    FOX23’s Abbie Alford has been digging into this story and found this isn’t Torres’ first hit-and-run charge.

    Municipal court records show in 2003, Tulsa Police arrested Torres for DUI/Alcohol, Hit & Run, Transporting Beer and No Driver’s License.

    Records show a day later he bonded out of jail and after about eight months Torres stopped showing up for court.

    Tulsa Police then issued a warrant for his arrest.

    Immigration Customs Enforcement (ICE) will not confirm if he was deported at that time.

    However, that wasn’t Torres’ last run in with Tulsa Police. Records show three years later officers arrested him again on that 2003 warrant. Records show The City of Tulsa Court found him guilty and no jail time but Torres paid a $745 fine.

    So what happened between 2003 and today?

    FOX23 is being told ICE did make contact with Torres both times. Officials say that would mean Torres-if he were deported or voluntarily left the U.S and returned to the country-he would be considered an aggravated felon.

    Six years later after his first arrest in Tulsa, Torres faces the law again and this time he’s accused of killing an elderly woman with his car.

    ICE says because of Homeland Security privacy issues it cannot release Torres’ history with ICE.

    However, an e-mail from an ICE spokesperson shows since ICE now has a detainer on Torres, “that basically means that we believe he’s deportable.â€

    A suspected illegal immigrant who police say killed a cyclist with his car has a criminal past.

    FOX23 was the first and only media outlet to report this information Thursday night.

    Court records show 28-year-old Roberto Alvelais-Torres has been jailed three times in Tulsa County for several charges, including DUI and non-injury hit-and-run.

    Now he’s charged in Tuesday’s hit-and-run that killed 74-year-old Beverly Duffield.

    So tonight we ask: How are Oklahoma’s immigration laws being enforced?

    FOX23’s Abbie Alford has been digging into this story to learn more information.

    A 577 page report details all the crimes linked to suspected illegal immigrants in Tulsa County in just the past couple of years.

    Since June, 2007 6,146 suspected illegal immigrants have been arrested and 2,722 were charged with crimes.

    The report shows most of their run-ins were with Tulsa Police.

    FOX23’s initial findings from the documents show since June 2007 most of the suspected illegal immigrants who have been arrested in Tulsa County and inside the city limits have been put behind bars because of Driving Under the Influence of a drug or alcohol and Public Intoxication.

    Drug offenses are also common but so is Driving Without a License and Insurance.

    Looking at one arrest Galvan Rufino spent only five months in state prison for a hit-and-run, which the report says, caused great bodily injury.

    There are also a number of reports showing suspected illegals jailed for minor traffic offenses such as speeding or failing to use a turn signal.

    In the initial report there are few reports of suspected illegals tied to violent crimes.

    However, 27-year-old Rosalio Morin is serving a nine-year prison sentence for sexually abusing a child.

    A new state law designed to cut down on prison overcrowding allows convicted illegal immigrants to be deported after serving two-thirds of their prison time.

    For Morin, that would mean he could be released in about five years.

    Oklahoma’s HB 1804 which went into effect November 2007, makes it one of the toughest immigration laws in nation.

    Currently, there is a federal injunction against employers who fail to comply with HB 1804. It regards employers and verification of their workers immigration status.

    However, under 1804 you could be charged for knowingly housing and transporting an illegal immigrant.

    There is a separate federal case that says HB 1804 is completely illegal and has moved to the State Supreme Court.

    Since Oklahoma HB 1804 passed only one person has been charged with transporting an illegal immigrant. In that case a Tillman County judge deferred the case and there was no conviction.

    MADD attended a public forum after the deaths of a mother and her young daughter in Brewster, NY only to claim that the fact the driver was an Illegal Alien had no bearing on the 'facts'. To paraphrase: We need to educate 'all residents' to the dangers of drinking and driving.

    Oh really...you don't say!

    This is what happens when at the local level, we have police agencies across this country who refuse inquire into someone's immigration status once in custody. They just release them where they usually go on to commit more crime and in some cases, kill innocent Americans!

    Illegal immigrant sentenced in Tulsa fatal bicycle crash

    A man identified as an illegal immigrant was sentenced Monday to seven years in prison for leaving the scene of a fatal accident in Tulsa.

    Roberto Salvador Alvelais-Torres, 28, pleaded guilty to five counts linked to a hit-and-run crash that claimed the life of bicyclist Beverly Duffield, 74, of Tulsa.

    In accordance with a plea deal, Tulsa County District Judge Tom Gillert sentenced Alvelais-Torres to a seven-year prison term for leaving the scene, a felony.

    Alvelais-Torres received a concurrent one-year jail term — which doesn’t add to his time in custody — for negligent homicide, a misdemeanor.

    Assistant District Attorney Julie Doss said there was no evidence that Alvelais-Torres was driving under the influence of alcohol or drugs.

    Evidence that a traffic death was caused by driving under the influence provides a basis for a first-degree manslaughter charge.

    The maximum jail term for negligent homicide is one year. The maximum prison term for leaving the scene of a fatal accident is 10 years.

    Alvelais-Torres was handed concurrent 30-day jail terms — which also do not add to his time in custody — plus fines for driving without a license and failing to carry insurance verification. He also was fined for failing to stop at a stop sign.

    Investigators said he was driving a sport utility vehicle near a U.S. 75 exit ramp at 17th Street on the morning of Sept. 1 when he failed to stop at a stop sign and struck Duffield, who was riding a bicycle.

    An Oklahoma Highway Patrol trooper said Alvelais-Torres, who has
    been in the Tulsa Jail since his Sept. 1 arrest, was an illegal immigrant who has been living in Tulsa. An arrest and booking report indicates that he was born in Mexico.

    With his Tulsa County case resolved, Alvelais-Torres continues to be held for federal immigration officials, according to jail records.

    Duffield, a clinical psychologist, was well-known in the bicycling community and at Community of Hope United Church of Christ.

    She also was well-known among mental-health professionals and at St. John Medical Center, where she frequented the health center and volunteered.

    According to a state trooper, a witness reported that a Chevrolet Suburban hit Duffield when both were heading south at the B&R Service Road and 17th Street near Southwest Boulevard. Medics pronounced Duffield dead at the scene, an EMSA spokeswoman said.

    In addition to the prison term, Gillert ordered Alvelais-Torres to pay fines and victims compensation assessments totaling $1,925, plus court costs.
