Texas plots new legal attacks on Biden agenda: migrant trafficking and environmental destruction

State Attorney General Ken Paxton reveals plans for new litigation designed to put Democrats on defense on two cherished issues.

Texas is plotting two new lines of attack against the Biden administration's agenda, seeking to turn the cherished liberal causes of reuniting illegal migrant families and protecting the environment into legal liabilities, Attorney General Ken Paxton told Just the News.

Paxton's office has already filed 18 lawsuits against President Biden's agenda on behalf of Texas, won more than a half dozen favorable rulings and elevated one issue — the state's new heartbeat abortion law — to the U.S. Supreme Court for emergency arguments this week.

But he said his lawyers are focused on two novel arguments to stem the flow of illegal migration by targeting two prized Democrat priorities.

The first will seek to argue that the Biden administration is engaged in human tracking with a program that flies family members from Central America to the United Sates to reunite them with illegal aliens who unlawfully crossed the border.

"The Biden administration now is working on flying other family members, minors, up at taxpayer expense, flying them to the United States to reunite with the rest of their family," he told the John Solomon Reports podcast. "One, that's completely illegal. There's nothing that allows for that in the federal law. In effect, it's a complete violation of law.

"So we're looking at that as a potential lawsuit, because it's just another way for the Biden administration to accomplish this goal of getting, I think their goal is to get 10 million illegals in the country in four years. And we're going to do our best to hold them accountable to following federal law."

Paxton said his second goal is to initiate a green lawsuit that argues the Biden administration is unlawfully spoiling sensitive environmental lands and water near the border by allowing unmitigated illegal immigration.

"We've got environmental issues along the border that are being created by all this illegal immigration," he said. "I haven't heard the environmentalists say a word about it. But it is a reality that the rivers are being polluted. And there's a lot of pollution related to this problem."

Paxton said his efforts to sue the Biden administration into legal compliance on a range of issues received some vindication in Tuesday's elections as voters chose law and order candidates and Republicans won some key races handily and beat expectations in some others.

"It was a great win for us," he said. "And I think it's a repudiation of this president who says, 'I'm not for America. I'm going to do what I want. I run the show, and I do what I think is best. It doesn't matter what the law says. It doesn't matter what the courts say. It doesn't matter if the entire country doesn't want it. We're gonna shove it down your throat. That's what he's doing."
