ALAMOGORDO, N.M. (AP) — A man stopped at a Border Patrol checkpoint near Alamogordo with marijuana plants told officers he thought marijuana was legal in New Mexico, police said.
Charles Barnes, 24, had 67 marijuana plants in the trunk of his car when he was pulled over on U.S. 70 last week, police said.
"Dude, I totally thought weed was legalized in New Mexico," Barnes told police.
Barnes told police he wanted to see how marijuana would grow in the Cloudcroft area, according to the Otero County Narcotics Enforcement Unit.
The plants were mostly seedlings and weighed less than an ounce, so Barnes was released with a citation for possession of marijuana.
Police kept the plants.

I live in Fl. and we have had similar incidents here. One Illegal had marijuana sent to him Fed-Ex.When caught he genuinely seemed suprised.
We are having a terrible time with illegals raising hugh amounts of marijuana in their homes.Recently 3 bust in one week and the good old Anti American Civil Liberty Union is complaining because our Highway Patrol helped in the bust.ACLU thought the Highway Patrol had NO business helping in the arrest !"A Government big enough to give you everything you want,is strong enough to take everything you have"* Thomas Jefferson

Charles Barnes was likely a US citizen and had less than 1 ounce of the material on his person. It doesn't compare to the vast amounts of MJ smuggled over our border with Mexico on every given day by the illegals.

I agree they probably look the other way a lot for the smugglers - but this guy did have 67 plants in his truck. That's quite a haul.Join our efforts to Secure America's Borders and End Illegal Immigration by Joining ALIPAC's E-Mail Alerts network (CLICK HERE)
