LAREDO — Investigators say the 36-year-old man shot to death by a Border Patrol agent on the banks of the Rio Grande had a long history of illegal entry and was found as recently as January with drugs.

Laredo police spokesman Joe Baeza said Victor Hugo de la Cruz was deported at least five times previously before he was confronted by a Border Patrol agent Wednesday night. That night, de la Cruz and others were found with 260 pounds of marijuana.

He and an agent got into a scuffle, and the agent shot de la Cruz in the chest. Investigators do not believe de la Cruz, who was from Nuevo Laredo, Mexico, was armed.

He was apprehended as recently as January, and although drugs were found nearby, Baeza said he was not charged and was deported.
