    Sheriff Joe Arpaio PHOENIX -- Maricopa County Sheriff Joe Arpaio says the federal government released three illegal immigrants arrested in a crime sweep because their arrests didn't fit new Department of Homeland Security policies.

    Because the three people had committed no other criminal or civil violations, the deputies were instructed by federal Immigration and Customs Enforcement agents to let them go free.

    Arpaio says DHS breached a promise that he could operate under an existing agreement that allows him to enforce immigration law.

    A DHS spokesman says federal officials would evaluate the immigration arrests during the sweep.

    MORE: 200 deputies hit Southeast Valley for 'crime suppression'

    The sheriff's office launched a three-day "crime suppression operation" aimed at suppressing crime and illegal immigration Thursday, concentrating on Chandler and Queen Creek and surrounding areas.

    As of Thursday night, deputies made 36 arrests -- eight of them illegal immigrants on state charges.

    After reading this article, I did a little research. From what I discovered, the new policy is a revision of the old "catch & release" policy. In other words, the three individuals released were probably released with a date to appear in immigration court. Knowing this, I think it's safe to assume the individuals were processed at the police station (fingerprinted, photograped, etc.).

    I think we all know that the chances of these illegals reporting to immigration court is small. More than likely they'll relocate to another city, county, or state.

    I guess there is a miniscule consolation in knowing that failure to appear in immigration court will generate an automatic deportation order. If an amnesty ever is passed (Lord forbid), I doubt anyone under a deportation order will qualify.

    Sheriff Joe Arpaio said Friday the federal government refused to take three illegal immigrants arrested in a crime sweep Thursday because their arrests didn’t fit new Department of Homeland Security policies.

    Arpaio said the department breached a promise that he could operate under an existing agreement that allows him to enforce immigration law.

    Homeland Security is requiring all local police agencies with existing 287(g) agreements to sign new ones within the next three months that are in accordance with new policies and department objectives or else lose their authority.

    In issuing the new 287(g) policies July 10, Homeland Security said it was concerned that local police were using minor infractions to get illegal immigrants deported.
    Nothing wrong with that. According to the authors of the original 287(g) progam, that meets the intent of the program. The original intent of the program, as I understand it, was to give all 287(g) participating law enforcement agencies the authority to process all illegal aliens they come into contact with during the official performance of their duties (yep, minor traffic violations qualify). Supposedly, according to law, ICE was supposed to respond to the arresting agency and transport the illegals to the appropriate venue until deportation could be accomplished.

    My question is, since when does DHS have the authority to change law that was passed by the peoples elective representatives (Congress)? Obviously they can do it, but that still doesn't mean I understand it.

    Well I don't give a crap what HLS says, the 9th circuit court decided that state and local police have the right to enforce immigration laws...they only need ICE to deport them, I say arrest them, make them serve their time and drop them off at the closest border and tell them to stay out of your state....even if it is just another state...let that state deal with it!

    Sheriff Joe should call the Border Patrol instead of DHS (I Know They are Connected) cause I think the BP would be more then happy to deport the IA's.

    Gotta Love Sheriff Joe and I think he is calling DHS's Bluff because Sheriff Joe knows ALL IA's are suppose to be deported under 287g. All the News Paper stories are helping to let people know what DHS is up too and I bet ICE's phone is ringing off the hook with irate citizens.

    Actually, that's not a bad idea! Doesn't the Border Patrol have jurisdiction within 100 miles of the border? How far is Maricopa County from the border?
