Mexican National Sentenced For Illegal Re-Entry After Deportation and Armed Robbery

INDIANAPOLIS — Joseph H. Hogsett, United States Attorney, announced today that Hector Tadeo-Martinez of Mexico, was sentenced to 111 months in prison today by U.S. District Judge Tanya Walton Pratt following his guilty plea to one count of being an illegal re-entry into the United States after deportation and one count of brandishing a firearm in connection with a crime of violence. This case was the result of a six-month investigation by the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) and U.S. Immigration and Customs Enforcement (ICE) Office of Homeland Security Investigations.

On or about January 27, 2009, Merry’s Bakery located on West Michigan Road in Indianapolis, was robbed by four males using a firearm, one of whom was Hector Tadeo- Martinez. Video surveillance shows that the group drove a white Jeep Liberty to the bakery. One person remained in the Jeep, while Tadeo-Martinez, and two others entered the bakery and proceeded to rob the establishment. A black pistol was brandished during the commission of this robbery. The subjects obtained approximately $100 from the store's cash register and an additional $100 from an employee's purse.

On December 4, 2009, Tadeo-Martinez was arrested by the Indianapolis Metropolitan Police Department for public intoxication and failure to identify. The Marion County Jail contacted ICE who determined that Tadeo-Martinez and re-entered the United States unlawfully, having five prior deportations and a criminal history which included convictions for theft and aggravated assault. After Tadeo-Martinez was turned over to federal authorities, ICE and ATF determined that Tadeo-Martinez participated in the bakery robbery. Three other men have cases pending in district court in connection with the January 27, 2009 robbery.

According to Assistant U.S. Attorney Bradley P. Shepard, who prosecuted the case for the government, Judge Walton Pratt also ordered Tadeo-Martinez’s to pay $200 in restitution. Tadeo-Martinez is subject to deportation after he is released from prison.
