A man detained by U.S. Border Patrol agents allegedly spat blood and assaulted an agent, while he was being transferred to another vehicle.

According to court documents obtained by Action 4 News, an FBI agent observed Alberto Mayen who was present in the U.S. illegally try to escape by twisting the arm of a U.S. Border Patrol agent.

The incident happened at the Rio Grande City Border Patrol station.

After allegedly twisting the agents arm, Mayen then fled on foot. When the agent caught up to him, a violent encounter begun.

Mayen was told to stop resisting multiple times in Spanish, but kept assaulting the agent by hitting his rib cage, documents say.

Another agent witnessed the violent encounter and ran to assist.

That’s when Mayen allegedly spat blood on the agent.

According to court documents, the agents were able to detain him and put him in a U.S. Border Patrol vehicle.

The assisting agent was sent to the hospital as he suffered a cut on his hand, an injured left knee, chest pain and difficulty breathing.

Mayen was present in the U.S. illegally from Guatemala.

A detention hearing was set for August 30, and a pretrial related to the assault on a federal agent is pending.
