AURORA (MyFOXColorado.com) - 23-year old Francis Hernandez may not be to blame for the triple fatal car wreck in Aurora two weeks ago. At least that's what his attorney is saying.


"My client was on the far inside lane and Pat Guntharp--who was driving the white pickup--was making an illegal left-hand turn over a double yellow line and four lanes of traffic," said Kallman Elinoff.

"It may be that she put herself and her passenger, Debbie Serecky, at risk by making a turn into what we think is the exit for the Good Times Hamburger establishment."

Guntharp's son, Adrian Gange, can't believe what he's hearing about the attorney's questions.

"That guy, Hernandez, shouldn't have even been out of jail with all the charges he's been involved with. I mean, I loved my mom and she shouldn't have been killed like that, no one should not her friend Debbie (Serecky) and not that little boy (Marten Kudlis)," said Gange.

"He should just man up be a man about it admit what you did and face the music."

Police say they are standing by their initial finding that in fact Hernandez had been speeding, weaving in and out of traffic, and probably ran the red light at Mississippi while heading south on Havana. While Ms. Guntharp may have been turning across the double yellow lines, that is permitted in Rules of the Road, if you do not impede traffic in the process.

Hernandez is being held in the Arapahoe County Jail under $350,000 bond on several charges including three counts of vehicular homicide, eight counts of leaving the scene, two counts of assault and one count of driving without a license.

Gange, at his mom's funeral, was handing out bracelets that simply said "Remember." He said he would love to give one to the man who police say killed his mother.
