Man accused in border agent's death said freed in Mexico
    THE ASSOCIATED PRESS
TUCSON — The head of the union representing U.S. Border Patrol agents says a man imprisoned in Mexico in connection with a Yuma-based agent's death has been released by a Mexican judge.
National Border Patrol Council president T.J. Bonner says an unidentified Mexican judge released Jesus Navarro for time served.
"Every Border Patrol agent in the country is outraged and stunned by this," Bonner said.
Border Patrol spokesmen in Washington did not return a call immediately, but the Department of Homeland Security was preparing a statement.
Navarro, arrested Jan. 22 in Mexico, was being held in a Mexicali prison. Mexico had sought him for allegedly smuggling migrants.
He was suspected of running over and killing Border Patrol agent Luis Aguilar on Jan. 19 as Aguilar tried to deploy spike strips to stop his drug-filled vehicle in southeastern California.

Why was he NOT EXTRIDICTED to the U.S.?

Did Jesus Navarro even stand trial?

There better be some official complaints lodged with the Mexican government over this incident.

Statement by Homeland Security Secretary Michael Chertoff

    Release Date: June 25, 2008

    For Immediate Release
    Office of the Press Secretary
    Contact: 202-282-8010

We are shocked and appalled to learn that Jesus Navarro Montes was recently released by a Mexican Judge. Navarro Montes is a suspect in the murder of Border Patrol Agent Luis Aguilar. Agent Aguilar was killed in a heinous act of violence on January 19 in the Yuma Sector, while attempting to stop two vehicles that illegally entered the country and were absconding into Mexico.

We are working with a determined Mexican Government, and our Department of Justice, to seek swift justice for the Aguilar murder. We have also assured Agent Aguilar’s family that every resource is being called upon in the relentless pursuit of justice.

Agent Aguilar’s murder represents a tragic example of border violence. We are placing our highest priority on combating and ending the increase in violence, and the American public stands with the men and women of the Border Patrol as they carry out their heroic service.

Ex-con arrested in border agent's killing

Jesus Navarro Montes was arrested Tuesday in the town of El Yaqui
Investigators say he was in a Hummer that contained drugs at border
Navarro Montes tried to flee agents who stopped him, running over one, officials said

Luis Aguilar, 32, a U.S. Customs and Border Protection agent, died Saturday

(CNN) -- Mexican police have arrested a man in connection with the death of a U.S. border patrol agent last week, according to a statement issued by authorities in Mexico.

Jesus Navarro Montes is accused of running over a U.S. Customs and Border Protection agent Saturday.

Jesus Navarro Montes was arrested Tuesday in the town of El Yaqui, said the statement from Mexico's attorney general.

"Initial investigations indicated that Jesus Navarro Montes left Mexicali, Baja California, heading for the United States in a Hummer SUV that is believed to have contained drugs," the statement said.

"That same day, Border Patrol stopped him; in trying to avoid the agents, Navarro Montes ran over one of them and fled into Mexican territory."

Luis Aguilar, 32, a U.S. Customs and Border Protection agent who was assigned to the Yuma, Arizona, station, died in the incident Saturday, U.S. authorities have said.

The incident occurred in the Imperial Sand Dunes Recreation Area near Andrade, California, near where the state lines of California and Arizona and the U.S.-Mexico border meet.

Officials say drug-smuggling driver killed border agent
Homeland Security Secretary Michael Chertoff said Aguilar was attempting to stop two vehicles believed to have entered the country illegally and were trying to abscond back into Mexico when he was struck and killed.

Navarro Montes had previously been arrested and imprisoned for transporting 10 undocumented immigrants to the United States, Mexican authorities said.

Try telling that to the family of Luis Aguilar. I bet they would have a different take on the matter...

Suspect in Border Patrol agent's death is freed

    UNION-TRIBUNE

    9:12 p.m. June 25, 2008

A man jailed in Mexicali on suspicion of fatally running down a Border Patrol agent in January has been released without charges, it was reported Wednesday.
The attorney general's office in Baja California confirmed to The Associated Press that Jesus Navarro Montes had been released from a Mexicali jail. No explanation for his release was given.

Navarro was arrested Jan. 22 by Mexican authorities. He was accused of driving a Hummer carrying drugs on Jan. 19 near Yuma, Ariz. Border Patrol Agent Luis Aguilar was placing spike strips on a road to stop the Hummer and a second vehicle when he was struck and killed, Border Patrol authorities said.

Mexican authorities alleged Navarro kept going, crossed into Mexico and gave the Hummer to accomplices.
