    KSDK -- It was one of St. Francois County's largest round-ups of undocumented workers and the sheriff said he did it because too many citizens in his county are out of work.

    Sheriff Daniel Bullock explained that Thomas Construction, located out of Lake of the Ozarks, should be employing local, legal residents. Last Saturday, deputies went to the future site of a Hampton Inn in Farmington and took 12 people into custody who were working there, as well as two others they found while searching for the workers.

    Bullock said that all of the people taken in are living in the U.S. illegally, but when they contacted U.S. Immigration and Customs Enforcement (ICE), the agency said to release all but one of the people. ICE would not say why that one individual needed to be held.

    As for the others, Gail Montenegro, spokeswoman for ICE, said they have to prioritize based on available resources and detention space.

    "Our top priority would be anything or anyone related to terrorism and beyond that we are, we are most interested in individuals who present the greatest threat to public safety," she said.

    "To me, this is terrorism. It really is, especially in today's economy," said Shane Pelliccio, an out-of-work carpenter protesting in front of the site Wednesday. "This is the USA. If you want to work here, be an American citizen."

    "Beyond that, St. Francois County is working at an 11 percent unemployment rate, the nation's unemployment rate is around 9 percent," said Sheriff Bullock. "There are many people here in St. Francois County out of work that could be doing these construction jobs at $13 an hour."

    NewsChannel 5 has not heard back from Hampton Inn's corporate offices.

    No one from Thomas Construction would comment on the issue, nor would ICE about whether charges would be filed against the construction company.

    (Farmington, MO) -- People in one Missouri county are speaking out after a group of illegal workers were arrested and then set free.

    It happened in Farmington, which is located in St. Francois County.

    This past weekend, the sheriff says he arrested 14 illegal immigrants. The men were hired to help build a new hotel.

    The sheriff says he hoped the arrests would help restore jobs to legal citizens. The unemployment rate in St. Francois County is more than 11 percent.

    But when the sheriff called the Office of US Immigration and Customs Enforcement, he was told the case was not a priority and he had no authority to continue holding the men.

    The explanation isn't sitting well with some residents.

    "They're taking jobs away from people that need jobs right now that are US citizens," says Gerald Bowyer, an unemployed glass worker. "To me, it seems like the illegals in this country got more rights than what the Americans do."

    For his part, the sheriff says he'll continue to investigate complaints of illegal workers, but fears the arrests will end with more releases.

    Why don't they charge these people with tax evasion when they are caught working illegally? It's a felony, gets them fast track deported and hopefully the employers can be charged with aiding and abetting.

    I get sick every time I hear this BS excuse! ICE should be given as much as needed to process every IA that comes into contact with ANY agency of the LAW!

    So in other words, your run of the mill illegal invader, who is stealing jobs, using fradulent/stolen identification (god only knows what else) is basically being given defacto amnesty because our very own ICE is not interested in deporting them.

    This is enough to make my blood boil!!!!

    If you remember, it wasn't any better with BUSH. The entire country is filled with illegal aliens. Bush and McCain both wanted CIR.

    ICE simply doesn't have the manpower to Pick everyone up.
    I'm not saying it's a good excuse, I'm just stating a fact.

    I'm looking into two Ohio cases. Two different Mexican nationals were involved in seperate accidents that caused injuries and one fatality. In both cases they had multiple DUI / OVI convictions, yet they were never picked up, by ICE. I'm trying to determine if the local law enforcement agencies even reported these crimminals. I suspect they didn't.

    The law enforcement agencies have been helpful. If they had info., they shared their "public record". Please understand they don't share eveything. (Although, our taxes pay for ALL the records).

    In the case with the fatality, the Elyria PD and the Sheriff gave me copies of their records. It's only for the most recent accident.

    The OHIO State Patrol doesn't share an accident report, unless I know the incident no. Well I don't. This may force me to file a FIA request.

    My hope is for the crimminal "case docket", which Lorain Co., is mailing me. The mailed info. is suppose to be more informative than the record available on line. I'm hoping it has some info. that indicates the three or more previous incidents.

    I also made a request to the OHIO BMV. We'll see how that turns out. That records request was $5.

    I hope to inquire of the local law enforcement agencies, if they reported these aliens to ICE. If they did, what was the reply. If they didn't, why not.

    The Mexican National indited for vehicular homicide even has a record with the FBI, so why was he never picked up, by ICE, BEFORE the fatal accident.

    It's not a problem of Democrat vs Republican. Both parties have plenty of politicians that fail to enforce good laws and see they are enforced.

    ELYRIA, OHIO — Emelio Hernandez-Perez, the driver of the Jeep that slammed into the back of Neil Jalowiec's car Dec. 15, instantly killing Jalowiec, was indicted yesterday for involuntary manslaughter and two counts each of aggravated vehicular homicide and operating a vehicle under the influence of alcohol, according to Lorain County Common Pleas Court documents.

    Hernandez-Perez, 23, of Elyria, had an alcohol content more than three times above the legal limit and was served with a specification stating he has previously been convicted of or pleaded guilty to three or more drunken driving violations, according to the indictment.

    Jalowiec's daughter, Leesha Doehr, of Elyria, has been following the case very closely, she said, and she is "very pleased" with the indictment. She said it was "a lot more than she expected it to be."

    "It seems like the system works sometimes," she said.

    Hernandez-Perez will be arraigned on Feb. 4 and she added she plans on being there.

    "I plan on being present there with anything that has to do with him," she said. "I mean, obviously, it's not a fast enough process for me, but it shows how the system works and the prosecutor's office has done a great job working with me."

    Hernandez-Perez was arrested Dec. 18 for aggravated vehicular homicide. The warrant was signed after Elyria police officers received the results of blood tests Hernandez-Perez agreed to take while being treated at EMH Regional Medical Center.

    According to the blood tests, Hernandez-Perez had a blood alcohol content level of 0.30. Because his blood alcohol level was significantly higher than the 0.08 legal limit, he faces enhanced penalties.

    Jalowiec, 65, of Grafton, was driving his gold Buick south on West River Road in Elyria and was slowing to a stop to make a left turn when Hernandez-Perez, who was driving a red Jeep Cherokee, slammed into the back of his car at a seemingly high speed. The Cherokee embedded itself into the back of the Buick and pushed it through the intersection.

    Hernandez-Perez has been held at the Lorain County Jail in lieu of posting a $250,000 cash bond.
