SAN BERNARDINO - The kidnap and rape of a 4-year-old girl triggered a 30-year-to-life prison term Friday against an illegal immigrant who claims that two unidentified men forced him to assault the child.

"We don't think he'll ever get out of custody," Deputy District Attorney Lynn Poncin said after the sentencing hearing for Sinoe Salgado Garcia, a 28-year-old Fontana man.

Garcia initially confessed to the December 2005 attack in San Bernardino, but he later recanted.

The child required surgery to repair damage caused by the rape and sodomy, court records show. She also suffered three facial fractures.

The girl was abducted while she and her parents were at a party, along with some 200 other guests, on the 1300 block of Vine Street.

A neighborhood resident found the child several hours later inside a shed. The youngster had been thrown over a 6-foot-tall block wall, investigators said.

Based on descriptions of a suspicious man seen at the party, police tracked down Garcia at his home, where they also found a bloodstained jacket.

On June 20, Garcia pleaded guilty to two counts of aggravated sexual assault on a child and two counts of lewd or lascivious acts with a child under age 14.

But when he was interviewed by a probation officer, who wrote a presentencing report for the judge, Garcia denied raping the girl.

Asked why he had confessed to a detective, Garcia said the officer pressured him into admitting guilt, probation Officer Brady Lock reported.

"He would like the court to know that he was raped on the night of the incident by two other men," Lock wrote to San Bernardino Superior Court Judge John Martin.

The men forced Garcia into a car, where he first saw the little girl, the defendant claimed.

"They made him put a condom on and told him to have sex with the little girl," Lock said. "When asked how his body fluids ended up on the little girl and how her blood ended up on his clothing, (Garcia) stated that he's trying to figure out how that happened.

"When confronted with the fact that he gave three different stories in the police report and now is giving a fourth story, he stated that he sticks to this new story."

Garcia was born in Guerrero, Mexico. The Department of Homeland Security has placed an administrative hold on him, based on immigration and naturalization laws.

Lock recommended that the judge imprison Garcia for as long as possible.

"The defendant's actions are indicative of behavior that needs to be eliminated from society," Lock concluded.

I am sure the devil made him do it! Seems to me though 30 yrs is a small amount for a crime of this degree, I would think live without parole would have been more like it, he will probably be out in less then 10 yrs with the kind of parole boards we have now. 4 yrs old, think of your little girl in the hands of an animal like this, do you think that is enough time? Next time he will make sure he kills the child.
