Man who held migrants seeks $1 million
By Gary Grado, Tribune
July 23, 2005
An Army reservist arrested for holding illegal migrants at gunpoint intends to sue the Maricopa County Sheriff ’s Office for wrongful arrest unless he is paid $1 million
Patrick Haab, 24, of Mesa, spent four days in jail before the county declined to press aggravated assault charges. Maricopa County Attorney Andrew Thomas determined Haab made a legal citizen’s arrest and was defending himself.
"There’s no doubt Patrick’s been harmed," said Douglas Loefgren, Haab’s attorney.
On Tuesday, Loefgren gave the county a notice of claim, which is a prerequisite to filing a lawsuit against state or local governments.
Haab has until April 10 to file a lawsuit.
"As far as I’m concerned, it’s frivolous," said Maricopa County Sheriff Joe Arpaio, whose deputy arrested Haab on April 10.
Arpaio said he stands by the deputy and welcomes a trial.
Haab encountered seven illegal migrants at a rest stop on Interstate 8 near Gila Bend, where he said he had stopped to stretch his legs and walk his dog.
Haab said they came out of the brush and rushed him and ran to a parked Chevrolet Suburban.
Haab said he pulled out his handgun and forced the men to the ground.
A deputy arrived and placed Haab under arrest.
The arrest came as frustration over illegal immigration mounted in Arizona and a group of citizen volunteers patrolled the Mexican border to spot illegal immigrants.
Numerous Hispanic groups criticized Thomas for not pressing charges, saying that it encourages others to copy Haab.
The man who was driving the Suburban, Jesus Olivera-Antonio, pleaded guilty in U.S. District Court in June to attempting to smuggle humans across the border. The other six men were considered witnesses in his case and released after providing depositions.
A California lawyer has threatened to sue Haab on behalf of the illegal migrants.

Citizen stops an illegal entry.
Sheriif's Department arrested the Citizen.
US District Attorney files "attempting to smuggle across the border" against 1 and releases 6. So, we're still stuck with all 7!
How does that happen when all 7 were captured?

The whole world is upside down.
As a side note: Sheriff Joe Arpaio is the guy that makes all the prisoners wear pink clothing and pink handcuffs.
