Round Lake Park man faces deportation

A 20-year-old Round Lake Park man entered a modified guilty plea Monday in Lake County Circuit Court to sexually assaulting a 24-year-old woman, and was sentenced to 4½ years in prison.

Luis Alberto-Garcia of the 200 block of Washington Street entered an "Alford" plea, which acknowledges that testimony and evidence would lead to a conviction, but does not directly admit guilt.

The plea, negotiated by prosecutor Bolling Haxall and Assistant Public Defender Kathleen McGee, affirms that Alberto-Garcia "struck the woman about the head" before sexually assaulting her. As part of the recommended plea, prosecutors dropped two of three counts.

Judge James Booras accepted both the recommended plea and sentence.

The felony is a Class 2 offense and carries a maximum sentence of seven years in prison.

Alberto-Garcia will get credit for more than 250 days already served in jail, awaiting trial, and will qualify for day-for-day credit in prison for good behavior.

Booras told Alberto-Garcia that after serving the sentence he may be deported to his home country, El Salvador.
