A man suspected of being an illegal alien is facing charges he left the scene of a fatal accident after the vehicle he was driving hit a motorcycle on a Mississippi road and killed two people.

Prosecutors in the county say the June 24, 2007, accident claimed the lives of Wayne Hughes, 45, and his wife, Michelle Hughes, 48, who had lived in Saucier.

Raymoundo Rojas Garcia was driving the pickup truck that hit the cycle, and he had been ordered to remain at the scene during the investigation. But authorities said the 27-year-old soon disappeared.

The crash happened on a sunny Sunday morning after the Hughes had eaten at a restaurant. They were northbound on their Suzuki when Garcia's southbound pickup made a left turn and hit their motorcycle.

Police say an off-duty state trooper stopped immediately and told Garcia and his family to remain by the roadside, but Garcia soon left, and were tracked down a short time later on a nearby street.
He was standing there talking on a cell phone," said one defense lawyer.

Garcia now faces up to five years in prison on each count if convicted. But authorities said the results of blood-alcohol tests they did did not support filing charges of felony driving while intoxicated.

Garcia remains in custody on bond of $100,000, but the U.S. Immigration and Customs Enforcement agency also has a hold on him for investigation of immigration law violations.

Garcia's connection to the crash drew criticism when it became known that Gulfport police had arrested him less than a week before on a misdemeanor drunken driving charge.

Police said Garcia didn't have a driver's license and they had no way of knowing his legal status within the United States. His own lawyer said he wasn't sure of Garcia's status.

It's just the latest in a long list of cases on which WND has reported involving illegal immigrants who have not only ignored U.S. immigration laws, but state laws against drinking and driving as well, killing innocents on the highways in the process, including:
