Expanded Entry of Driver’s License and State ID Information in E-Verify

On Sept. 17, 2018, E-Verify expanded its access to Department of Motor Vehicles (DMV) records.

Now, if an employee presents a driver’s license or state ID card as a List B document for Form I-9, and if the document is issued by one of the states and territories under E-Verify’s expanded access, E-Verify will prompt the user to enter the document information into E-Verify.

E-Verify is using this process to prepare for an expansion of driver’s license and state ID verification capabilities.

Please note that states participating in the Records and Information from DMVs for E-Verify (RIDE) program will continue to verify the validity of driver’s license and state ID card information.

I totally oppose this. This type of over-reach is going to kill a simple E-Verify to prevent illegal aliens from getting jobs. E-Verify is tracking citizens, storing and compiling information, just like the corrupt, dishonest NSA program. Has nothing to do with illegal aliens any more. Shame.

Employees must provide documentation to their employers to show their identity and authorization to work.

Documents that Establish Both Identity and Employment Authorization

The documents on List A show both identity and employment authorization. Employees presenting an acceptable List A document should not be asked to present any other document. Some List A documents are in fact a combination of 2 or more documents. In these cases, the documents presented together count as one List A document.

U.S. Passport or U.S. Passport Card

Permanent Resident Card or Alien Registration Receipt Card (Form I-551)

On May 1, 2017, USCIS began issuing redesigned cards that no longer display the individual’s signature. However, some cards issued after May 1, 2017, may still display the previous format. Both the previous and new cards will remain valid until the expiration date shown on the card. These cards are also known as “Green Cards.”

The previous version of the cards was issued after April 30, 2010, and may or may not contain a signature. A signature is not required for the card to be valid for Form I-9, Employment Eligibility Verification.

Note: Some individuals who present this List A document, such as certain nonimmigrant students and exchange visitors, must present additional documentation in order to prove their work authorization in the U.S.

In April 2013, Form I-94 was automated at airports and seaports. U.S. Customs and Border Protection no longer automatically provides travelers with a paper copy of Form I-94. Travelers may access Form I-94 information through the U.S. Customs and Border Protection website or may request a paper Form I-94 during the inspection process.

A Form I-797 issued to a conditional resident may be an acceptable List C document in combination with his or her expired Form I-551. I was thinking about all these State Food and Health Inspectors. They inspect restaurants and establishments multiple times a year and post a score on the windows for the public to see. I think States should take over the I-9 Audit process and inspect these work places on a regular basis. If the feds don't think a State is doing the job, then the Feds can intervene. Just an idea.
