    Cell Phone Records Place Suspect In San Diego

    SAN DIEGO -- Authorities searched Monday for an 8-year-old girl who was kidnapped from her Nevada home and possibly brought to San Diego County over the weekend.






    The California Highway Patrol issued an Amber Alert for Lydia Rupp after she was taken from her home in Fernley, Nev., on Friday.

    The suspected kidnapper is Fernando Aguero, the live-in boyfriend of the girl's mother and a registered sex offender in California, according to the sheriff's office in Lyon County, Nev.

    Aguero, who was born in Tijuana, used his cell phone in the Imperial Beach area to call his sister and is believed to have crossed the border with the girl into Mexico, law enforcement officials told The San Diego Union-Tribune.

    CHP Officer Alicia Contreras said Monday morning that the Amber Alert is still in effect because law enforcement officials believe Aguero is moving back and forth between Mexico and San Diego County.

    Authorities told the Union-Tribune that Aguero stole all the girl's clothing, her birth certificate and her pet cocker spaniel.

    Rupp is Latina, has brown hair, brown eyes and scars on her cheeks. She weighs 85 pounds and is 4 feet 9 inches tall.






    Aguero, a Latino, has silver-grey hair, a moustache, scars on both arms, and a large scar on his lower right leg and foot.

    The CHP said Aguero was last seen in San Diego County driving a bluish silver 2001 Kia Rio with paper plates that say Reno Mazda Kia.

    Anyone who sees the pair is urged to 911 or the Lyon County, Nevada, Sheriff's Office at (775) 463-6620.

    The convicted sex offender who kidnapped 8-year-old Bethany-Rose Rupp from her Fernley home on Friday has crossed the border into his native Tijuana, Mexico, officials reported Sunday.

    However, he reportedly told his sister in Las Vegas that he has not harmed the girl and is trying to find a "good Christian family" so he can return her to her family.

    According to Capt. Jeff Page of the Lyon County Sheriff's Department, Fernando Peons Aguero's mother is also working with authorities from her home in Mexico.

    "She advised Lyon County detectives that she would try to have Fernando contact them," Page said. "She has been assisting in the investigation to have Lydia returned to her mother."

    Rupp's mother met Aguero at a church function in April. He later moved into their home as a roommate.

    He dropped the mother off at work Friday around 5:30 a.m., but called at noon to say he could not pick her up.

    The mother returned home to find Aguero and her daughter both gone. He had taken with them the child's birth certificate, Social Security card and all photographs from the home, as well as the family's brown cocker spaniel.

    A warrant has been issued for Aguero's arrest on charges of first-degree kidnapping and bail is set at $1 million.

    Aguero, aka Fernando Ayala, aka Fernando Pons, was convicted in Los Angeles for lewd and lascivious behavior with a child under 14 in 1985, served a year in prison and was released. He is 5-feet, 10-inches tall weighs between 165 and 175 pounds. He has a slim build with dark graying hair, brown eyes and a mustache.

    He has a large, 8-inch scar on his lower right leg and foot and noticeable scars on both arms, as well as a surgical scar on his right shoulder. He was driving a bluish-silver 2001 Kia Rio four-door sedan with no plates.

    Rupp is 4-feet, 9-inches tall, 85 pounds, brown hair, brown eyes with a medium complexion. She has scars from dog bites on her cheeks.

    This is the second Amber Alert to be issued out of Lyon County. The first, in June 2004, resulted in the children being recovered. Across Nevada, 25 Amber Alerts have been issued and 23 of those children were located. The other two were taken to Mexico.

    The Lyon County Sheriff's Office is working with the Nevada Department of Public Safety, California Highway Patrol, National Missing & Exploited Children, Child Find and the FBI.

    Updated article. I heard this guy at one time was an illegal but later got amnesty. I don't know about anyone else but the picture below sort of sends chills down my spine looking at it. Hopefully he will have an unfortunate accident while in prison.

    Nev. Girl Found in Mexico Glad to Be Home

    An 8-year-old girl who authorities said was abducted by a convicted sex offender celebrated her safe return home by sharing a group hug with her mother and older brother, and declaring "I missed you guys."

    Clutching a Teddy bear and wearing sunglasses, the girl flew from San Diego to Reno on Sunday, two days after she and Fernando Aguerro were found staying in a shelter in Ensenada.

    "I missed you guys," the girl said shortly after arriving at Reno-Tahoe International Airport. "Home is good. It's great to be home."

    Aguerro, who had a romantic relationship with the girl's mother, is accused of kidnapping the girl July 22 from her home near Reno and sexually assaulting her.

    She was accompanied on the flight by her mother and Lyon County sheriff's Capt. Jeff Page.

    "She's happy. She's overjoyed to see her mother," Page said. "She's a wonderful child to bring home."

    The girl's name was reported as authorities searched for her, but The Associated Press does not normally identify victims of sexual assault. The girl's mother said she did not know about Aguerro's criminal past when she had a relationship with him.

    Aguerro remains in the custody of Mexican authorities, who have said they want to try him on rape and kidnapping charges. If convicted in Mexico, Aguerro could serve up to 38 years in prison.

    Page said he would turn over final results of an investigation later this week to District Attorney Leon Aberasturi, who will decide whether to charge Aguerro after consultation with the U.S. Attorney's and Nevada Attorney General's offices.

    Aguerro, convicted in Los Angeles in the 1980s of lewdness with a child and served a year in prison, could receive life in prison without parole if convicted of kidnapping in the United States.
