GRAND RAPIDS — The defendant is back in Mexico, so there will be no trial Monday in Branch County Circuit Court for Luis Jiminez, 42, who was to stand trial on the life felony charges in the sexual abuse of two young girls at a Sept. 3, 2006 party.

U.S. Immigration and Customs Enforcement (ICE) returned him to his home country as an illegal alien, after bond was dropped here this summer.

A spokesperson for ICE said the agency had no legal grounds to retain him since there were no holds. Jiminez signed the standard federal agreement to allow ICE to repatriate him voluntarily.
