Morganelli wants to deport man with 6 DUI arrests

DA also wants immigrant's bail revoked.

    February 19, 2009
A Mexican immigrant's sixth drunken-driving arrest was too many for Northampton County District Attorney John Morganelli, who said Wednesday he is seeking to have the man's bail revoked and urging federal authorities to deport him.

Guadalupe N. Vasquez had already racked up five priors when he was arrested Aug. 10 after hitting a car at an Easton Wawa, Morganelli said. He had a 0.23 percent blood alcohol level, nearly three times the legal limit.

Though Morganelli labeled Vasquez, 43, of 218 W. Kleinhans St. in Easton, an illegal immigrant, the district attorney said he married a U.S. citizen and was issued valid alien registration and Social Security numbers in 2003.

Immigration and Customs Enforcement wouldn't comment on Vasquez's immigration status, but said there are no detainers on him.

''It's too early to tell if we can bring proceedings against him,'' said spokesman Mark Medvesky. ''We're going to work with the DA's office.''

Vasquez was charged in 2001 with violating federal immigration laws, according to Morganelli, in a case he said has an unknown result. Vasquez's drunken-driving convictions, some of which were under his many aliases, occurred in 1993, 1994, 1996, 2001 and 2007. The heftiest sentence was one to two years in prison.

He also has a conviction in early 2003 for giving an Easton manufacturer false identification papers.

Vasquez is free on $10,000 bail in his latest case, which includes a cocaine possession charge. A hearing on Morganelli's request for higher bail is slated Monday.

A friend of Vasquez said he has lived in the United States for nearly two decades and has no family remaining in Mexico.

Arturo Dominguez of Easton said Vasquez is separated from his wife. He said Vasquez is in the country legally and has his own Social Security card and driver's license.

Vasquez works mostly in landscaping and recently found a job in a factory after being on unemployment for a while, said Dominguez, whose girlfriend helped post Vasquez's bail.

''The time that I know him, I've never had a complaint, nothing,'' Dominguez said.

If convicted of the latest drunken-driving charge, Vasquez would face a mandatory one year in prison and maximum of five years.

Northampton County DA wants to deport immigrant with growing rap sheet

    Lou Dobbs would be proud.

Northampton County District Attorney John Morganelli agrees with the CNN anchor that the U.S. needs to take a hard stance against those who enter the country illegally.

Morganelli is asking federal officials to deport a man facing his sixth drunken-driving charge. The man entered the country illegally but now is a permanent resident.

"I have asked (U.S. Immigration and Customs Enforcement) to remove this individual before he kills someone and yet another victim is added to the long list of U.S. citizens that have been killed by illegal aliens who drive drunk on the streets of the United States," Morganelli said at a news conference Wednesday.
Guadalupe Nieto Vazquez, 46, who has several aliases, was most recently charged with drunken driving and careless driving after sideswiping a car Oct. 10 in the Wawa parking lot off Washington Street in Easton.

His blood-alcohol content was 0.23 percent, almost three times the legal limit. He is free after posting 10 percent of $10,000 bail.

Morganelli's request is not unprecedented, according to Immigration and Customs Enforcement spokesman Mark Medvesky, who said people have been deported because of a criminal record.

"We're looking into it. At this point, it's too early to say," Medvesky said of Vazquez. "We'll just have to see how this progresses."
Vazquez, who is also known as Jose Guadalupe and Guadalupe Nieto, illegally entered the country but later got a green card when he married a U.S. citizen, Morganelli said. Even with the green card, he still could be deported.

To keep Vazquez off the streets as federal authorities examine the request, Morganelli wants to increase his bail. A hearing is scheduled for Monday.

Vazquez was convicted of drunken driving in 1993, 1994, 1996 and twice in 2007. Vazquez faces a minimum of one to five years in prison if convicted. His trial is set to begin in April. It is unclear if he faces charges in other states because of his numerous aliases.

Morganelli has long been an outspoken proponent for tightening the country's borders with Mexico because he says criminals, terrorists and other people know it is a sieve. Morganelli supports enforcing federal laws rather than local governments creating their own.

I know you don't and I know I don't, but who would be stupid enough to think that is a reason to keep this dangerous repeat offender in our nation???
