    The chief executive of a construction company accused of hiring an illegal immigrant who worked on Omaha's federal building is expected to enter a plea on a criminal charge.

    Randall Tufly is charged with continued employment of an illegal immigrant. He is chief executive and owner of Omaha's Tufly Co.

    Court documents filed Wednesday say Tufly hired Gabriel Rios around March 2007.

    Federal officials accuse Tufly of illegally employing Rios after discovering that he was a Mexican citizen, and not authorized to be in the United States or work here.

    Rios worked on several jobs through late June 2007, including renovation of the Zorinsky Federal Building.

    The chief executive of an Omaha drywall company has agreed to plead guilty in a case involving the hiring of illegal immigrants.

    Plea agreements were filed in U.S. District Court in Omaha on Thursday for Randy Tufly and Tufly Commercial. He is chief executive and owner of Tufly Company, which includes Tufly Commercial and other limited-liability corporations.

    Randy Tufly agreed to plead guilty to a single misdemeanor charge of harboring an alien. He was sentenced to three years of probation and ordered to serve 150 hours of community service.

    His company also agreed to plead guilty to harboring illegal immigrants. A judge ordered the company to pay a $150,000 fine and to retain someone approved by the U.S. probation office to ensure compliance with immigration and labor laws.

    Investigators say a number of Tufly employees, who were incapable of passing a background check, were issued temporary badges to circumvent a security check.

    During the investigation, it was revealed that the business was contracted to work on the renovation of the Zorinsky Federal Building. During the project, company emails reflected a need for more workers. Nine undocumented workers were brought to the site in March 2006.

    I cannot understand why scofflaws such as this, who now have a confirmed history of hiring illegals, are not mandated to use E-Verify if they want to remain in business. Hopefully, they are!
