    Police Units Wait Two Years To Perform ICE Duties

    If the Fort Smith Board of Directors directed the Police Department today to apply for a federal program that allows local police to conduct investigations of suspected illegal aliens, it likely would be two years before the city knew if its application was accepted.

    Section 287(g) of the Immigration and Nationality Act that authorizes the Department of Homeland Security to enter into agreements with local law enforcement, permitting trained local officers to perform immigration law enforcement functions under the supervision of local U.S. Immigration and Customs Enforcement agents.

    The timetable for acceptance into the 287(g) program was revealed in an e-mail from Katrina Berger, assistant special agent in charge of the ICE office in New Orleans.

    Our government can fast track illegal aliens into the country to clear a back log but they can't jump and take action when it comes to enforcement.

    Duh!!!! If you had been doing the latter the former wouldn't have been a problem.

    Get your priorities strait!!!!!!!!

    Now lets see, the CFI/SPP plans are to have our borders erased by 2010. Just a little more than 2 years from now.....

    The 287 (g) is presently the only game in town when it comes to local law enforcement making any headway in fighting illegal immigration and getting the illegal alien criminals out of our towns. We will continue the revolving door, "catch and release" if the hands are tied to detain, investigate and have the ability to deport criminal illegal aliens.

    This is utter madness.

    We have been working tirelessly to have our city and county adopt this program. Now we stand in a long line, just like those who want to legally come to the United States, and still the illegal aliens are just out of reach as they continue to fleece Americans and our American communities.

    The City and County officials, along with law enforcement, that wish to do nothing and pass it off as a federal issue only, will just use this as a further excuse to continue to do nothing and in the meantime the numbers of illegal alien invaders will only increase and threaten us even more.

    These people are just making things way too difficult, on purpose, it sure would seem. The illegals are still coming everyday by the thousands and there are only a few thousand ICE agents and we need our local law enforcement to not be left impotent to act.

    Figures there is a backlog due to the high number of requests to the 287g program.
    What dept does the fed government run efficiently?

    Maybe some thinkl it's a waste of money since the plan is the NAU!

    Today I had the pleasure of a long discussion with a city police officer on the problems of illegal aliens. She came into my business on an unrelated matter and I asked her if the city was planning on training any officers with ICE and the 287g program. She didn't know but expressed that she wishes our police chief would do something. She told me a number of stories about illegals whom they have had to release because they aren't authorized to hold them- tens of thousands of cash dollars that illegals use to post bond and then never show for their court date- dozens of latino gang members in the county that the average citizen is totally unaware of (or refuse to believe exist). She said the chief claims to not even have the phone number for ICE available IF they wanted (i stress 'wanted') to contact them about an illegal alien in custody. I gave her the ICE contact I have for our region, she was appreciative. She said one officer with ICE training and a computer could go a LONG way in curbing illegals in our city. We talked about the city being short on officers, the county being short on deputies, the funding cuts, etc.. & The drugs that come through our county thanks to illegal aliens from Mexico.

    So, this alleged 2 year waiting list in order to receive ICE training should be thoroughly investigated. I guess the traitors in Washington didn't expect so many law enforcement departments across the nation to want to take part in ridding our country of illegal alien criminals. Now they have to come up with an excuse to slow things down a bit. Another load of Washington BULL-S**T in my opinion.

    FORT SMITH -- Dissatisfied with the federal government's response to illegal immigration, the Fort Smith Board of Directors on Tuesday decided to move forward with plans for enforcement at the local level.

    Section 287(g) of the Immigration and Nationality Act authorizes the Department of Homeland Security to enter into agreements with local law enforcement that allow trained local officers to perform immigration enforcement actions under the supervision of local U.S. Immigration and Customs Enforcement agents.

    Shortly after a presentation from Police Chief Kevin Lindsey, Director Bill Maddox made a motion that the city begin earmarking funds needed for participation and that Lindsey prepare a detailed participation plan for review.

    Director Ken Pyle said Fort Smith doesn't have to just throw its hands up in the air because the federal government has failed.

    Former city prosecutor Rick Wade supported participation in the 287(g) program.

    Wade said in 15 years as city prosecutor only once was he able to persuade federal officials to take into custody a person who was identified as an illegal immigrant in district court.

    But even with the decisive action of the board Tuesday, participation in the program won't come quickly or without a price.

    The timetable for acceptance into the program was revealed in an e-mail from Katrina Berger, assistant special agent in charge of the ICE office in New Orleans.

    "The time frame for acceptance into the 287(g) program following the initial request is estimated to be two years," Berger wrote in the e-mail to Lindsey. "There is still a huge back log and a large number of requests that are already in front of any request your agency may make."

    Although ICE, as part of the Department of Homeland Security, covers the cost of the five-week training for officers, Lindsey estimated that compensating for two officers assigned full-time to immigration matters would cost about $131,000 a year.

    Pyle asked if two officers would only amount to a "ripple in the water" and if more should be trained.

    Lindsey said he would have to study more information to make that determination, which the board directed him to do.

    Directors said they would like to have a plan from Lindsey within the next couple of weeks so the city could apply was soon as possible.

    Lindsey said it is a political process, so he recommended contacting the state's congressional delegation.

    Mayor Ray Baker said the congressional delegation also should be urged to appropriate more money for training local officers, who are being forced into action to enforce federal laws because of Congress' failure.

    Too many politicians won't do more to ensure enforcement of federal immigration laws because they're afraid it might affect their chances for getting re-elected, Baker said.

    Director Rick Parrish said he also wanted it made clear that he is looking for local police, if accepted into the program, to do more than just process illegal immigrants arrested on criminal charges.

    If someone is stopped for a traffic violation and it's determined the person is illegal, Parrish said he expects that person to be arrested.

    Lindsey said that could be done, but federal, not local, officials would determine if the person is detained or released.
