Creekstone Farms to question immigration status of suing workers

An attorney for Creekstone Farms Premium Beef wants to know whether two workers suing the company are legal residents of the United States.

The attorney for the workers, though, said the company is trying to intimidate his clients and scare other workers from joining the class-action lawsuit, which claims that Creekstone does not pay for all hours worked.

Paz Sanchez and Elvis Posadas are the lead plaintiffs in the case, which was filed in federal court during the summer.

It claims that the local beef plant does not pay workers when the production line is not running or when they are putting on their uniform and equipment.

Their Overland Park attorney, Mark Kistler, filed a "protective order" in July to prevent Creekstone attorney Alan Rupe from obtaining personal information, such as Social Security numbers, date and place of birth, tax returns, and work visa documents.
