Rubashkin seeks to have nearly 100 counts dismissed

The former manager of a kosher slaughterhouse wants a judge to dismiss nearly 100 counts against him, and if not, to allow him to be tried separately on different charges.

In motions filed Friday in U.S. District Court in Cedar Rapids, Sholom Rubashkin asks the court to dismiss 97 charges against him, arguing that the grand jury was biased by improper testimony and conduct.

The indictment against Rubashkin and four other defendants followed a May 12 immigration raid at the Postville plant that resulted in 389 arrests.

Rubashkin's attorney asks that immigration and bank fraud charges his client faces, as well as a charge of violating an Agriculture Department order regarding the sale of cattle, be handled through three separate trials.
