NEW CITY, New York (AP) -- A man who had been hired to clean a backyard deck was convicted Wednesday of raping and murdering a suburban homemaker.

The slaying drew wide attention because afterward the man allegedly used the victim's cell phone to brag about the crime to her relatives.

Douglas Herrera Castellanos, 30, faces life in prison without parole when he is sentenced in May.

The husband of the victim, Mary Nagle, 42, cried when the verdict was read.

At a news conference, Daniel Nagle said it was a "day that brings back the sorrow, but a day that also reminds us that justice will be done."

The couple had two children, a 9-year-old girl and a 6-year-old boy.

Herrera, 30, was convicted of all 15 counts against him, including first-degree murder, rape, robbery and other charges.

Herrera's attorney, Barry Weiss, said: "I expected it from Day 1. I'm not the least bit surprised."

The killing in April 2005 had exposed fears about a common situation in the suburbs -- the wife home alone and a handyman on the scene.

Five women said they received calls -- made from Nagle's cell phone in the hours after her death -- from a man with a Spanish accent who spoke lewdly about what had happened to Nagle. Herrera had Nagle's cell phone with him when he was arrested.

Herrera, a Guatemalan immigrant whose visa expired five years ago, was the only defense witness.

He said he did not remember entering the house or killing Nagle but did recall waking up next to her bloody body.

(New City-WABC, April 5, 2006) - A Rockland County jury has returned a guilty verdict against Douglas Herrera on all 15 charges -- including first-degree murder -- in the death of 42-year-old Mary Nagle of New City.

Eyewitness News reporter Tim Fleischer has the details from the courthouse.
That jury has found Herrera guilty on all 15 counts -- the most serious of those counts is guilty of murder in the first degree. He now stands to spend the rest of his life in prison.

30-year-old Herrera was emotionless as the verdict was read today. The jurors responding by saying guilty, guilty, guilty to all charges stemming from the death of Mary Nagle. Her family and her husband Daniel say this verdict is important.

Daniel Nagle, victim's husband: "I'm glad we reached murder ... victory, the one that we wanted. I think we're here today because of Mary. We're here today for the people of Rockland County and the surrounding people, myself and my family and everyone who lives here."

Ann Falon, victim's sister: "This is a victory for our family today, it's still a sad day."

The jurors spent two and a half hours deliberating in the case. I spoke with juror Wayne Assorto who said: "It was tough. I just hope the family has some peace now and closure. It was really tough."

Herrera now faces life in prison without parole.

The Nagle family, on the other hand, hopes they can move forward. This verdict, they say, is coming in Mary's memory.

Yesterday, Herrera admitted in court that he woke up next to Mary Nagle's blood soaked body. For Mary Nagle's family, it was an extremely emotional day having to listen to all this graphic testimony.

In his own defense, Douglas Herrera claimed he remembered very little that April morning when Mary Nagle's body was discovered in her home where Herrera had come to work.

The 30-year-old Guatemalan painter claims in what he says was a lot of beer and using about $300 dollars worth of cocaine the night before, he showed up at Mary Nagle's house dizzy and smelling of alcohol.

His attorney Barry Weiss asked: "What do you remember?"

Herrera: "Waking up next to the victim."

Weiss: "In the same bed?"

Herrera: "Yes. I was very frightened. I woke up next to her. She was naked and my right leg was over her. I got up."

Weiss: "What did you see?"

Herrera: "I saw a lot of blood, I saw a lot of things in disarray, I saw my clothes full of blood. It was horrible."

Meeting with reporters, Weiss said of his client: "Based on his drinking and cocaine use during that time period, whether he had the mental capacity to commit these crimes."

Prosecutors countered with a quick exchange, asking Herrera: "Did you check to see if Mary Nagle was alive?"

Herrera: "No."

Prosecutor: "You didn't care?"

Herrera: "I was frightened."

Prosecutor: "You didn't care if she was alive?"

Herrera: "No."

Prosecutor: "The reason you didn't check to see if she was alive because you already knew that you had killed her."

Herrera: "I had no reason to do it."

The testimony was so disturbing at times that Daniel Nagle -- Mary's husband -- and her sisters were in tears.

Daniel Nagle: "I'm devastated by the fact that he can sit up on the stand looking at pictures of my wife, pictures that I can't even look at myself, and feel very confident to say that he wasn't there and doing anything."

The testimony earlier was graphic in detail as Rockland County Medical Examiner, Dr. Lone Thanning, described the brutal torture of Mary Nagle as she was raped and murdered.

Thanning: "The injuries just got progressively worse, especially the brutality of the combination of all these forces."

NEW CITY, N.Y. � A prosecutor described in nightmarish detail Thursday the rape, mutilation and killing of a suburban housewife, allegedly at the hands of a worker who was supposed to be power-washing her deck.

The assault on 42-year-old Mary Nagle was so brutal that crime-scene investigators found a piece of her ear and hanks of her hair scattered around her bedroom, Rockland County District Attorney Michael Bongiorno said at the start of the defendant�s trial. After killing Mary Nagle, Guatemalan citizen Douglas Herrera changed into clean clothes belonging to Daniel Nagle and used Mary�s cell phone to call 51 people on the phone�s internal list. Many family and friends learned of the horrendous crime from the killer himself, who also threatened them.

As is common in many of these cases, the killer had a prior arrest that should have sent him back to his nation of origin, but he was allowed to stay, with tragic results.

News of the crime cooled the enthusiasm of many area homeowners for hiring total strangers from foreign countries. �The lady told me, �Pablo, I don�t want to see you today,� � said Mr. Sandoval, an �immigrant� laborer.

Illegal Alien Killer of Mary Nagle Found Guilty on All Counts

On Wednesday, while the Senate was debating about which way to destroy the country, another tragedy due to Washington irresponsibility was being played out in a New York state courtroom, as one more murder by an illegal alien was tried.

The crime was brutally clear. It took jurors only 2 1/2 hours to find illegal alien Douglas Herrera guilty on all 15 counts of raping and murdering suburban mom Mary Nagle in her home. (See earlier Vdare account with photo here and local obituary.) Herrera had been hired to power-wash the deck of the Nagle home, but instead took the opportunity to attack and kill his employer.

There were tears in the eyes of some jurors, too, when medical examiner Lone Thanning provided them with a clinical but grisly account of the victim�s injuries. Nagle _ the mother of a 9-year-old girl and a 6-year-old boy _ fought with her killer for at least 15 minutes, Thanning testified, and perhaps for as long as 30 minutes.

The killer inflicted �among the most horrific injuries I�ve ever seen,� Thanning said. The jurors passed a tissue box, while some members of the panel simply turned away from the crime scene photos. [Accused killer: I don�t remember anything about that day, Newsday, 4/4/06]

After the rape and murder, Herrera used Mary Nagle�s cell phone to call her friends and family, including her sister, making lewd comments as he bragged about the crime.

The killer overstayed a 2001 tourist visa from Guatemala and possessed a California driver�s license. He reportedly will be sentenced in May to life in prison without parole.

In another demonstration of disdain for the safety of American citizens, on Tuesday Senate Democrats blocked an amendment that would bar illegal aliens convicted of felonies from obtaining U.S. citizenship.
