Illegal Alien Rapes 5-Year-Old Girl and Infects With Herpes

INDIANAPOLIS (WISH) - Police need your help to find a man accused of sexually assaulting a 5-year-old girl last month.

Metro Police believe Jose Oviedo is on the run. Detectives have been waiting for Oviedo to return to a eastside home on Michigan street. So far, no sign of him.

When a 24-Hour News 8 photographer knocked on the door, the man who answered said Oviedo had gone to Mexico.

Police were alerted to the situation when they recieved a 911 call on January 27th.

"He actually went out to the house where he found the little girl and he found out that yes she was molested. And he did a very detailed report," said Detective Steve Buchanan.

An affidavit reveals that a 5-year-old said her mother's boyfriend had molested her. The child's grandmother discovered signs of abuse and took the child to the hospital.

"We have confirmed through St. Francis that the child contracted an std and it's one that unfortunately she'll have for the rest of her life," said Detective Buchanan.

The police said while the 5-year-old's sexually transmitted disease was further proof of abuse. Officers said they were frustrated by the mother's unwillingness to give them any information about her boyfriend.

"I do know that when the mother and the daughter came to the child advocacy center I personally spoke with the mother and did not get any cooperation out of her," said Detective Buchanan.

Police removed the 5-year-old victim and her three siblings from their mother Crystal Newton's home.

24-Hour News 8 asked Newton if she took steps to protect Jose after she found out what had happened to her daughter?

Newton said, "I don't believe I did."

However, the police believe she did.

"Well the simple fact is that he gave me a fake name," said Newton. She also claims that even though she had dated Oviedo for at least 4 months, she didn't learn his name until after police began investigating him.

Police believe 30-year-old Jose Oviedo is an illegal immigrant and could now be living under an assumed name. He face 3 Class A felonies and one Class C Felony. Oviedo has been arrested 14 times in 10 years.

someone please send fax this article to every MExican consular office and to the offices of LA RAZA, LULAC and MALDEF. Every day they should be getting these faxes of these cases as a reminder that no matter how they and the Mexican government try to spin these people.....their behavior and criminality speaks for itself.

:evil: The little girl's grandmother should immediately take the child, file an 'order of protection' against her monster mother for not protecting her against her scumbag boyfriend. Then she should file an 'emergency order of custody' based on her grandchild's future physical & mental danger.
This really makes my blood boil! They should also arrest the mother for not protecting that poor baby. She was just as guilty as that fat scumbag.

According to the probable cause affidavit, the five-year-old girl was taken to St. Francis Hospital on January 26 with obvious signs of having contracted a sexually transmitted disease. She told police her mother’s boyfriend molested her. Police questioned the child’s mother who was unwilling to help police locate Oviedo.

Police then issued a warrant for Oviedo who is believed to be an illegal immigrant from Mexico. A tip to Crime Stoppers led U.S. Marshals to Little Rock, Arkansas where they spoke with family members. That’s when marshals learned Oviedo had given them the slip and fled to Mexico.

Supervisory Deputy U.S. Marshal John Beeman said since Oviedo is a Mexican citizen, authorities will have to begin extradition procedures in order to get him back to the U.S. to face charges. Beeman said it’s a long process.

First, the Marion County Prosecutor will file a lengthy, detailed extradition application. It then goes to the U.S. Department of Justice, the U.S. State Department, then the Mexican Consulate in Washington D.C.

Beeman said the process could take about six months before Mexican officials receive the paperwork. After the application is certified, it’s sent to the U.S. Embassy in Mexico. From there it will be sent to the Mexican Attorney General. Finally, a judge will issue a warrant for extradition.

But Mexican authorities can extradite at their discretion. If they choose not to extradite, Beeman said the current treaty requires Mexico to prosecute Oviedo for the crime.

In the meantime, it’s believed that Oviedo remains free in a small Mexican town, just 12 miles from the U.S. border.

This happens over and over and over. These illegals have been in police custody numerous times and yet they do not get deported.

This scum bag has been arrested 14 times in ten years. Why is he still here left to commit additional crimes?

I can not understand this.

We can't get these damned illegals out of the U.S., and we can't get them out of Mexico and back INTO the U.S. to face the consequences of their sick crimes, either.

Mexico has us right where they want us. We're just their puppets. :?
