Two students have been arrested after police said they raped a girl in the bathroom of a Montgomery County high school.

Police have charged 17-year-old Jose Montano and 18-year-old Henry Sanchez with first-degree rape and two counts of first-degree sexual offenses. The suspects were arrested at
Rockville High School by investigators. They are both are being charged as adults, Fox 5 DC is reporting.

According to court documents, the 14-year-old victim previously knew only one of the suspects. She was walking with Montano in a school hallway on Thursday at around 9 a.m. when he asked her for sex. The police report indicates she said no, but then the two suspects are alleged of forcing the girl into a boy’s bathroom and into a stall where they both raped, sodomized and forced her to perform oral sex. The police report indicates she said no repeatedly, tried yelling and tried to fight them off, but was unable to.

At one point during the alleged attack, they heard a noise at the bathroom door, according to the charging documents. Shortly after, they threw one of their jackets over the victim’s head, walked her out of the bathroom and left. Blood and other DNA were found by police in the school bathroom.

The girl reported the rape to school administrators and police were contacted, according to police.

In court, the Montgomery County State’s Attorney’s Office argued the suspects should be held without bond because they are a danger to the public and are a flight risk due to being in the United States for a few months from Central America. The judge in the case sided with prosecutors.

“They are charged with three very serious offenses that carry life in prison, so that is the maximum you can get in the state of Maryland,” said Ramon Korionoff, spokesperson for the Montgomery County State’s Attorney’s Office. “We prosecute criminals. We prosecute the cases as the evidence leads us in those cases and the immigration ramifications are determined at a later point by the proper authorities.”

Although the two suspects are 17 and 18 years old, they were enrolled as freshmen because they both arrived in the United States only a few months ago and were taking English as a Second Language (ESL) classes.

U.S. Immigration and Customs Enforcement has now lodged an immigration detainer on Sanchez. Prosecutors said he came to the U.S. from Guatemala and has only been in the country for seven months.

Two ninth-grade students accused of raping a 14-year-old classmate inside a high school bathroom last week will remain behind bars pending court proceedings, a Montgomery County judge ruled Friday.

Henry Sanchez, 18, and Jose Montano, 17, were arrested Thursday at Rockville High School and charged with three counts each in connection with the alleged rape of a female classmate.

Judge Eugene Wolfe refused to grant bond to either during a Friday court hearing and ordered them to remain in custody until their next appearance.

The girl, identified by law enforcement as “Victim A,” told authorities that she was walking in a school hallway Thursday morning when she was approached by the two boys, according to police documents.

“Montano asked Victim A for sex, which she refused. Montano asked again, more persistently, and pushed Victim A into the boys’ bathroom,” police wrote in a probable cause statement after interviewing the girl.

“Victim A was holding a sink to avoid going into the bathroom when Montano grabbed her hand and pulled her into the stall,” police wrote. Montano then began forcibly undressing the girl before Sanchez joined them inside the stall, according to police.

Both young men took turns raping the girl, according to police documents. She told administrators, who alerted police.

Mr. Montano and Mr. Sanchez were arrested at school that same day, and each was charged with first-degree rape and two counts of first-degree sexual offenses.

They have been charged as adults, and each faces the possibility of life behind bars if convicted, prosecutors said Friday.

“These are very serious allegations carrying a life sentence. The potential of life in prison would be available as we prosecute these individuals,” said Ramon Korionoff, a spokesman for the Montgomery County state’s attorney’s office.

Both teens have been in the United States for less than a year and pose a flight risk, The Washington Post reported from Friday’s court hearing.

Mr. Sanchez, a Guatemala native, arrived in the country about seven months ago and is the subject of a pending “alien removal” case, The Post reported.

Mr. Montano arrived in the U.S. about eight months ago, but U.S. Immigration and Customs Enforcement declined to comment on his status because he is a minor, according to WTOP.

“The immigration ramifications are determined at a later point by the proper authorities. We just are working very closely with our police and school security partners to ensure this case goes forward in a timely and executed manner,” Mr. Korionoff said.

Mr. Montano and Mr. Sanchez will remain in custody until at least their next hearings, scheduled for March 31 and April 14, respectively.

When I was working in the schools we had a 16 year old Hispanic student (boy) enrolled in elementary school. I don't know for sure if he was illegal or not but he couldn't speak english.

Suspect in rape at Maryland school was stopped 7 months ago by Border Patrol

One of the two suspects accused of raping a 14-year-old student at Rockville High School was picked up by a U.S. Border Patrol agent in Texas seven months ago, determined to have illegally entered the country, and issued a notice to appear in immigration court, federal officials said Monday.

The suspect, Henry Sanchez-Milian, 18, arrived in Montgomery County around that same time period, according to records filed at Montgomery County District Court. He was placed in ninth grade at Rockville High School, as was the other suspect, Jose O. Montano, 17, according to a court hearing last week.

Montano has been charged as an adult in the case.

Montano is accused of pushing the 14-year-old student into a boys’ bathroom during school hours Thursday morning and then forcing her into a stall as she tried to hold on to a sink, according to police affidavits filed in court. Inside the stall, he and Sanchez-Milian, whose name also is spelled as Sanchez in court records, took turns attacking the girl, according to court records.

Both teenagers have been charged with one count of first-degree rape and two counts of first-degree sex offense. The crimes carry possible sentences of life in prison.

The suspects’ accounts of the events have not yet been presented in public filings.

Montgomery County schools superintendent Jack Smith said Monday the allegations are “horrible and unacceptable.”

As part of a broader effort to review security measures, schools officials said Rockville High School staff were taking steps to more closely monitor hall passes and students coming in and out of class.

“I was immediately sick and disgusted” about the reports of what happened at Rockville High, County Executive Isiah Leggett (D) said Monday. “This should not happen. Period.”

Leggett said the two suspects had “no previous involvement in the county’s criminal justice system.” He said that if the suspects are convicted, he would “cooperate fully” with federal immigration officials to have them deported after serving any imposed prison sentences.

The suspects’ immigration status is a topic of high interest for residents in Montgomery County and, as news of the case spreads nationally, people in other states.

Available records at Montgomery County District Court show that Sanchez-Milian was born in Guatemala and lived there until he was 17.

“In August 2016, Henry Sanchez-Milian was encountered by a border patrol agent in Rio Valley Grande, Texas, who determined the individual had unlawfully entered the United States from Mexico,” ICE spokesman Matthew Bourke said in a statement. “Sanchez-Milian was issued a notice to appear in front of an immigration judge, which is currently waiting to be scheduled.”

Sanchez-Milian arrived in Montgomery County seven months ago, according to Montgomery County court records. After his arrest last week, ICE officials requested a “detainer” be placed on him at the county jail, meaning they are interested in possible future deportation proceedings.

ICE officials declined to comment on whether they have requested a detainer for Montano, saying they could not discuss his case because he is a juvenile. According to court records, Montano was born in El Salvador, lived there for 16 years, and also arrived in Montgomery County seven months ago.

Two Maryland high school students – one of whom has an “alien removal” case pending – forced a 14-year-old female classmate into a bathroom stall on Thursday morning and viciously raped her, police said.

The suspects, Henry E. Sanchez, 18, and Jose O. Montano, 17, are in ninth grade at Rockville High School.

Both are recent arrivals to the U.S., Sanchez from Guatemala and Montano from El Salvador, WUSA9 reported.

The pair appeared in court Friday and Montano is being charged as an adult, despite his age, due to the seriousness of the crime. Sanchez and Montano, charged with first-degree rape and two counts of first-degree sexual offense, were held without bond.

“I believe that you are a danger,” District Judge Eugene Wolfe told Sanchez, according to The Washington Post.
Police say Montano forced the girl into a school restroom after she refused to have sex with him. The girl fought back, at one point holding on to a sink to avoid the assault, but Montano allegedly pushed the girl into a stall where he and Sanchez took turns holding her down and raping her, according to the police affidavit.

After hearing a noise, Sanchez fled, but Montano simply tried to silence the girl, who eventually broke free and was able to tell a staff member, the police report said.

“Ensuring a safe, secure and welcoming learning environment for all of our students is our top priority,” a Montgomery County Public Schools spokesperson wrote in a letter sent to parents. “Our staff remains vigilant in the monitoring of our school each and every day.”

Two illegal-alien teenagers who were placed in ninth-grade classes at Montgomery County Schools, Maryland, have been arrested and charged with the brutal rape of a 14-year-old girl, and at least one of the boys had a pending deportation order from ICE.

Montano asked her for sex.
The girl refused.

So the two boys forced her into the boys bathroom.

Montano grabbed her hand and pulled her into the one stall with a door. Montano then pushed her into the corner of the stall and began kissing her neck, despite her repeatedly telling him to stop. He unzipped her top, forcibly removed her clothes and the two proceeded to rape her at the same time, then traded positions and raped her again.

She cried out in pain, the report says. But they allegedly continued the assault. By the time it was over, they had raped her anally, orally and vaginally, according to the police report.

The victim reportedly knew Montano as a friend but did not know Sanchez.

Sanchez had a pending deportation order, which was not carried out while immigration activists tried to block the deportation.

“18-year-old criminals set to be deported should not be a freshman in our public schools,” stated a post on the website of Help Save Maryland, an organization that opposes illegal immigration.
Maryland is perhaps the most welcoming state for illegal aliens and refugees in the Eastern United States, with Montgomery County the most welcoming county in the state. Maryland gives in-state tuition rates to illegal-alien college students, and its legislature is considering becoming a sanctuary state. Montgomery County is a sanctuary county, and it denied 63 ICE requests to turn over illegal-alien criminals last year, Fox News reported.

These policies helped create a culture that allows a young girl to be raped in her school bathroom by two illegal-alien boys, at least one of whom was ordered to be deported, border hawks told WND.

When interviewed by police, Montano denied having any sexual contact with the victim. Rather, he said they went into the bathroom to “tell jokes.”

The two male students were arrested later that day at school. The school system put out the following statement without saying why two young men, ages 17 and 18, were placed in ninth grade, nor did it reveal the immigration status of the accused students:

“Ensuring a safe, secure and welcoming learning environment for all of our students is our top priority. Our staff remains vigilant in the monitoring of our school each and every day.

Please remind your child that if they believe they are a victim of an assault or see something inappropriate, they should immediately tell a staff member.”

Forensic investigators said an inspection of the boys bathroom later turned up suspected blood “that may be mixed with male fluid,” the court documents stated.

Sanchez and Montano were living in the Aspen Hill neighborhood of Rockville, and they have been charged with first-degree rape and two counts of first-degree sexual offense. They were denied bond by a judge who said they were dangerous and a flight risk.

If convicted, they could get life in prison.

WUSA 9 confirmed that ICE had a detainer on Sanchez, a citizen of Guatemala, who had an outstanding deportation order for his arrest. Yet he continued to attend school in Maryland.

William Gheen, president of Americans for Legal Immigration PAC, said this is a rare case where the news of a rape of a student on school property managed to leak out into the local media.

“It’s a miracle that anyone is even hearing about this case, because first the victim had to report the crime, and a lot of crimes like this do not get reported.

“Secondly, once it was reported, it had to make it out of a school system. And quite often, schools suppress the sharing of information like this.

“And then you have to get past the local media, which often strives to conceal the crime altogether, or to conceal the immigration status of the perpetrator.”

He said ALIPAC is calling for “every single government worker” that put 17- and 18-year-old illegal immigrants in classes with ninth-grade children to be terminated from their jobs.

He’s also calling for full transparency concerning the perpetrators, who are both being tried as adults.

“We need to know if these particular illegal immigrants were beneficiaries of the Obama’s and now Trump’s DACA illegal amnesty program,” Gheen said.

‘People do what they feel they can get away with’
Hessie Harris, a spokeswoman for Help Save Maryland, said the boys “obviously had no fear” of being deported while they were in school, even though at least one was subject to deportation, having been denied asylum by a judge. She said Rockford officials have recently discussed codifying their sanctuary city policies and a bill has been introduced in the Maryland Legislature that would make it a sanctuary state.

“I really feel these policies are responsible for this type of behavior. People do what they feel they can get away with, so why would these boys think they could get away with this?” she asked. “I’ll tell you why. Because they are in Maryland and in a sanctuary city, and they don’t fear any type of repercussions.

“It’s horrible that a parent has got to fear sending their child to school. There are many other stories we’re hearing about, including one of a family whose child was transferred out of a school in Maryland because their child was being bullied by an illegal alien and the school wouldn’t do anything about it.”

She said most cases of rape and assault by violent illegal-alien students never see the light of day in Maryland schools. She believes it happens daily.
Gheen agreed.

Somehow all the hurdles mentioned above were cleared in the Rockville High School rape case.

But there’s one final hurdle that remains.

“We still have the final boundary that we haven’t broken yet, and that’s the national media,” Gheen said. So far, you don’t see CNN and the national media giving this story any play.

“From my years of experience, the Associated Press, Reuters, CNN, the New York Times will all bury this story,” Gheen said. “These kinds of stories reach their desk, and they either do not circulate them at all, or they sanitize the story to make it sound less important.

“This type of real news is systematically and consistently censored and suppressed, while fake news stories such as the Duke Lacrosse incident are emphasized,” he added, alluding to the Duke University case several years ago in which white, male lacrosse players were falsely accused of rape.

“If the story meets their narrative that ‘white males are evil,’ they run with it; but if the story shows that illegal immigration is harmful to Americans, they bury it.”

Gheen said the Maryland story is “very detrimental” to the efforts of all the Democrats and some Republicans – such as John McCain, Paul Ryan and Lindsey Graham – who want to give immigration reform/amnesty to illegal immigrants.

While the pro-immigrant activists continue to focus on emotional stories of “families being separated,” they give no attention to the families of victims like the 14-year-old girl who will now endure a lifetime of psychological torture, Gheen said.

“These young men obviously had no fear of law enforcement,” Gheen added. “They come from lands where there is no law enforcement. And they show they can come here and break laws with impunity, so why should they fear any boundaries, be they national or sexual boundaries?

“We hope that this unfortunate case will inspire President Donald Trump to honor his broken campaign promise to end DACA amnesty on his first day in office.

“The description of what happened to that little girl is off the scales of what anyone, let alone a child, should ever have to endure,” Gheen said.

“And Americans need to realize that, in this environment, could have been anyone’s daughter in that bathroom stall. The elites have flooded America with people who are dangerous to our future and our existence, and the number of victims out there are beyond what anyone would want to imagine.”

Harris, of Help Save Maryland, said Americans should be looking to Europe as the model of where things are headed.

“And one of the frightening things here is, if we look at Europe and see what’s happening there, if we don’t take action, rape could become the new normal here as it is becoming in Germany and Sweden,” she said. “In Germany, the rapes aren’t being reported. The police, in many cases, are giving up. That’s what it has deteriorated to. It’s finally come to the fore.

Finally, they can’t hide it anymore, can’t deny that it is happening.”

Harris said Maryland residents recently received a tax increase to provide for underfunded school budgets, and she believes an influx of illegal aliens is the primary driver.

At least 51 percent of Montgomery County students are recent immigrants, according to Fox News, and the numbers could be even higher in the lower grades, kindergarten through fourth grade. The school system has at least 19 foreign languages spoken by the student body.

“And so we’re paying for people who shouldn’t even be here. Budgets are full of all kinds of special programs we are funding for those students,” Harris said. “Maryland schools were once top tier. Now they’re going down. Some of these children coming into these schools, some have never been in a school and speak dialects for which you can’t even fine teachers. So we’re paying all kinds of extra money for these specialized programs. Why?

“We hear all these emotional stories about these are such vulnerable people and families being divided,” she added. “But what about the vulnerability of their victims? They’re vulnerable, they’re here illegally and they knew when they came here that was a policy of the previous administration, and they came here relying on lax enforcement. So when you break the law, there are consequences. When they crossed that border, they knew they could possibly be deported. And if they are deported, they can take their children with them.”

The Rockville High School attack follows a series of recent sexual assaults and rapes committed by illegal aliens against minors nationwide.

Earlier this month, 19-year-old Guatemalan Douglas Hus-Flores was arrested in Connecticut for sexually assaulting a 3-year-old girl, and 29-year-old Jorge Zapata-Rosas was arrested in Texas three weeks after raping a 7-year-old girl.

Parents blame immigration, others blame HS after alleged rape by undocumented immigrants

MONTGOMERY COUNTY, Md. (ABC7) — A brutal rape was reported at Rockville High School Thursday and some parents are blaming immigration enforcement, saying they dropped the ball. Meanwhile, other parents are questioning if the school system should take some of the blame.

The incident took place the morning of Tuesday, March 14 inside of the boys bathroom at the high school. Police say the 14-year-old girl was brutally raped by two fellow freshmen who entered the country illegally around seven months before from Central America. They were both placed in the ninth grade.

The victim tells authorities she was dragged into an empty stall from the hallway near the gymnasium around 9 a.m. when she was approached by two male students, later identified as Jose O. Montano, 17, and Henry E. Sanchez Milian, 18. According to court documents, she grabbed a sink trying to get away. Just minutes after the crime, she reported the alleged rape in class.

The younger of the suspects was detained by U.S. Border Patrol in August from Texas and was issued a notice to appear in immigration court, but that hearing was still pending at the time of the rape.

Thankfully, the alleged rapists were arrested by the police. Obviously, if convicted, these young men need to be severely punished for this heinous act, and I am confident that the justice system will do its job.

Although these individuals had no previous involvement in the County’s criminal justice system, these alleged rapists do have outstanding U.S. Immigration and Customs Enforcement (ICE) orders. If convicted, and after serving their sentences, the County — consistent with our longstanding policy — will cooperate fully with ICE to see that the two are deported to their countries of origin.

What a relief to know that there’s at least one circumstance under which a municipal government will cooperate with “Trump’s henchmen” in ICE.

ROCKVILLE, Md. - School was back in session at Rockville High School on Monday morning for the first time since two students were charged with raping a fellow classmate in a school bathroom. The alleged assault happened while classes were in session, but five days after the attack, there are more questions than answers as to how something like this could happen in the first place.

Police charged two Rockville High students -- 17-year-old Jose Montano and 18-year-old Henry Sanchez—with first-degree rape and two counts of first-degree sexual offenses in the rape of a 14-year-old girl inside a boys’ restroom. Both suspects remain in custody, and they’re being charged as adults.

The victim, who is a freshman, says the attack happened last Thursday morning around 9 am.

The suspects, though much older than the victim, are also both freshmen at Rockville High School. Sanchez is from Guatemala and is currently under a deportation order. Montano is from El Salvador. Both suspects have been in the United States for between 7 and 8 months, and neither have prior criminal records.

Charging documents detail brutal attack

Court documents released Friday describe a brutal attack. They say the victim knew Montano, but she did not know Sanchez. She told police she was walking with Montano in a school hallway on Thursday morning when he asked her for a hug, and then slapped her buttocks and asked her to come with him and Sanchez. The documents say when the three were walking near the gym, the two suspects forced her into a boys’ bathroom.

Despite repeatedly telling the suspects to stop and her attempts to fight them off, court documents say the victim told police the suspects took turns raping and sodomizing her, and forcing her to perform oral sex on them. The charging documents say there was a noise at the bathroom door at one point, and shortly after that the suspects threw one of their jackets over the victim’s head, walked her out of the bathroom and left. The victim then reported the rape to school administrators, and police were contacted. The documents say blood and other DNA were found in the bathroom.

In court, the Montgomery County State's Attorney's Office argued the suspects should be held without bond because they are a danger to the public, and a flight risk. The judge in the case sided with prosecutors.

More questions than answers

FOX 5 DC is demanding answers that the community is looking for in the case. The Montgomery County Public Schools Superintendent Dr. Jack Smith declined repeated requests to appear on FOX 5 News Morning to answer those questions, due to the ongoing criminal investigation.

In the past, Smith hasn’t been shy about speaking out against hate crimes committed in schools and the Trump administration’s policies on transgendered students. But following the alleged rape of a 14-year-old girl by two other students, he has so far only issued a statement (scroll down to read the full statement, and the letter sent home to Rockville High School parents). FOX 5 DC's requests for interviews have been declined, citing the ongoing criminal investigation.

Parents, however, are talking. Many told FOX 5 they are upset, angry, and want someone at MCPS to explain exactly how this happened, and what is being done to ensure it never happens again.

Among the questions they want answers to:

- Why are 17 and 18-year-old boys allowed to be with freshman girls who are as young as 14?
- Are students forced out of school at a certain age?
- Did Montgomery County Public Schools know that one of the suspects has a deportation order against him?
- How are unaccompanied minors who attend Montgomery County Public Schools monitored or tracked in the schools?
- What exactly is being done to ensure the safety of students in the future?

FOX 5 DC submitted these questions to MCPS on Monday, asking for a written response in light of Smith declining an on-camera interview.
Finally on Monday night, FOX 5's Marina Marraco was able to catch up with superintendent Dr. Jack Smith outside of his office to answer some of the community's questions. For the most part, Smith said he could not discuss any facts in the case due to the ongoing police investigation.

“The police and the courts will sort all of that out,” said Smith. “As I said in my letter last night, information will continue to come out in the coming weeks, so it is important for people, as horrible as this situation is, not to jump to conclusions or say things that they might eventually have to rethink or take back.”

Regarding why students as old as ages 17 and 18 would be enrolled as freshmen at the high school, the superintendent said, "We have a lot of 18-year-olds in our schools. Our student was actually in a METS [Multidisciplinary Educational Training and Support] Program for English learners and that is a program we have across the system, and so, it is not a matter of what grade they were in, but the student was in a program for English learners.”

Council President says Montgomery Co. isn’t a “sanctuary city”

Meanwhile Monday, in another part of the county, Montgomery County Council President Roger Berliner did take questions on the topic, which took over what was supposed to be his weekly news conference. He pushed back hard against questions that Democratic county leaders had somehow “coddled” or encourage illegal immigration in the county through policies sympathetic with a “sanctuary city.”

When FOX 5’s Tom Fitzgerald asked Berliner what responsibility school officials bear for what may or may not have happened on Friday, and whether 18-year-old men belong in classrooms with freshmen girls, Berliner responded, “I believe that is a question to be posed to our school system. As you know it is a state-run separate system. I understand the concerns of parents. I do believe it's a fundamental responsibility of the school system to have a safe environment. Nobody should ever be fearful that something ugly like this is going to take place."

ICE lists Montgomery Co. on list of jurisdictions that “choose not to cooperate” with detainers

But ironically, just as that interview was taking place and Berliner was saying Montgomery County is not a sanctuary city, the Immigration and Customs Enforcement released a report showing Montgomery County is on a list of jurisdictions that “choose not to cooperate with ICE detainers or requests for notification, therefore potentially endangering Americans.” Prince George’s County is also on the list.

When told of that announcement, Berliner said the county does cooperate when a crime has been committed.

In this statement released to the community Monday morning, MCPS Superintendent Dr. Jack Smith said the following:

“As you may have heard or read, a serious incident occurred at Rockville High School on March 16, 2017. The incident involves allegations of rape and the arrest of two students. I am deeply troubled by these allegations. The allegations presented in the charging documents are horrible and unacceptable. They do not represent the positive values of our students and school communities. Our thoughts are with the student who reported the incident and her family. Montgomery County Public Schools (MCPS) is committed to supporting them through these difficult times.

Please know that our school staff immediately contacted the Montgomery County Police Department (MCPD) once they were informed about the alleged sexual assault. MCPS continues to fully cooperate with MCPD and the Montgomery County State’s Attorney’s Office on this matter.

Rockville High School staff, with the support of the MCPS administration, are working closely with the students and the school community to address concerns, provide support, and review security measures.

I know community members have many questions about this serious incident. To ensure we do not unintentionally prejudice an ongoing investigation, MCPS cannot provide any additional details about this specific case at this time. However, we believe more information about this incident will be made available by law enforcement in the coming weeks.

The safety and security of every student in our district is our top priority and a responsibility that we do not take lightly. We have and will continue to work every day to ensure our schools are safe places to learn.”

Montgomery County Executive: 'Sick and disgusted'

Montgomery County Executive Ike Leggett released a statement Monday regarding the alleged sexual assault at Rockville High School:

"I was immediately sick and disgusted when it was reported that two young men raped a 14-year-old student at Rockville High School last Thursday. This should not happen. Period.

My deepest condolences go out to this young girl and her family.

"Thankfully, the alleged rapists were arrested by the police. Obviously, if convicted, these young men need to be severely punished for this heinous act, and I am confident that the justice system will do its job.

"In addition, I know that Police Chief Thomas Manger is hard at work with his staff investigating what happened and securing procedures to ensure our students are safe and their parents don’t have to worry. We are working with School Superintendent Jack Smith to support Rockville High School Principal Billie-Jean Bensen, and the entire Rockville High School community in this time while anxiety is high.

"Although these individuals had no previous involvement in the County’s criminal justice system, these alleged rapists do have outstanding U.S. Immigration and Customs Enforcement (ICE) orders. If convicted, and after serving their sentences, the County -- consistent with our longstanding policy -- will cooperate fully with ICE to see that the two are deported to their countries of origin.

WASHINGTON — One of two teens charged with raping a girl at a high school in Rockville, Maryland, entered the United States illegally and was questioned by border patrol agents in Texas less than a year ago, according to a spokesman with Immigration and Customs Enforcement.

Henry Sanchez-Milian, 18, was encountered by a U.S. Border Patrol agent in Rio Grande Valley, Texas, in August 2016. The agent determined that Sanchez-Milian had unlawfully entered the country from Mexico, said ICE spokesman Matthew Bourke.

“Sanchez-Milian was issued a notice to appear in front of an immigration judge, which is currently waiting to be scheduled,” Bourke said in a statement.
Bourke could provide no information about Jose Montano’s status because he is a minor.

Montano, 17, and Sanchez-Milian have been charged with rape for assaulting a 14-year-old girl in a boys bathroom at Rockville High School during school hours on March 16. Both teens were charged as adults.

“I was immediately sick and disgusted when it was reported,” Montgomery County Executive Ike Leggett said Monday in a statement. “My deepest condolences go out to this young girl and her family.”

Leggett said county police are investigating what happened and ensuring the school community is safe. He also noted that the two suspects have “outstanding orders” with ICE.

“If convicted, and after serving their sentences, the county — consistent with our long-standing policy — will cooperate fully with ICE to see that the two are deported to their countries of origin,” Leggett said.

Gov. Larry Hogan said he is “outraged” by the rape at the public school and called for answers.

“The State of Maryland is calling on Montgomery County to immediately and fully cooperate with all federal authorities during the investigation of this heinous crime. The public has a right to know how something this tragic and unacceptable was allowed to transpire in a public school,” Hogan said in a statement.

According to court documents, Sanchez-Milian is originally from Guatemala and arrived in Montgomery County seven months ago. Montano is from El Salvador and arrived in the area around the same time as Sanchez-Milian.

Both teens were attending the high school as freshmen.

Bourke said that ICE had placed a “detainer” for Sanchez-Milian, indicating he could face deportation.

In a letter to parents, Montgomery County Public Schools said school officials notified police immediately after the student reported the assault to a staff member.

“Ensuring a safe, secure and welcoming learning environment for all of our students is our top priority,” school officials said in the letter. “Our staff remains vigilant in the monitoring of our school each and every day. Please remind your child that if they believe they are a victim of an assault or see something inappropriate, they should immediately tell a staff member.”
