    ALBANY, N.Y. (AP) - Republican Assembly leader James Tedisco says Osama bin Laden is likely popping champagne over Governort Spitzer's new plan to allow illegal immigrants to get New York driver's licenses.

    Tedisco, joined by other Republican Assemblymen, says Republicans would sue if Spitzer and the Department of Motor Vehicles don't rescind the proposal by October 31. He claims Spitzer violated a state law in his policy.

    Spitzer spokeswoman Christine Anderson calls the legal threat baseless, that state law gives the DMV discretion to determine what documents are required to prove a license applicant's identity.

    Spitzer announced his plan last week and said it would bring "people out of the shadows" of American society when it goes into effect in December. Similar policies have been adopted in Utah, New Mexico and other states.

    Republicans said Friday that giving licenses to illegal immigrants would threaten the state's security, allow for voter fraud and inconvenience the citizens of New York.

    Tedisco threatens to sue over driver's licenses for illegal aliens

    State Assembly Minority Leader James Tedisco on Friday threatened to file a law suit if Gov. Eliot Spitzer does not reverse course on an executive order allowing illegal aliens to obtain driver’s licenses in New York.

    Before going that route, he first will attempt to make the change through legislation when the Assembly resumes session on Oct. 22, Tedisco, R-Schenectady, said in a telephone interview.

    "November first, if it doesn’t, we’re filing a law suit on behalf of the people of New York," he said.

    Tedisco said the new state policy, which Spitzer announced last week, violates a section of state law that requires applicants for driver’s licenses to provide a Social Security number or a letter from the Social Security Administration stating they are not eligible to participate in the system.

    Christine Pritchard, a spokeswoman for Spitzer, said the state’s highest level appeals court has upheld the right of a state Department of Motor Vehicles commissioner to change policy.

    "Those who are suggesting lawsuits fundamentally misunderstand the law in New York state," she said.

Eliot Spitzer's plan to give driver's licenses to undocumented immigrants through a lawsuit and legislation, but a gubernatorial spokeswoman predicted the courts would uphold the new policy.

    Powerful interests also entered the fray, with the AFL-CIO and Service Employees International Union/1199 praising Democrat Spitzer, while he was criticized by Conservative Party leader Michael Long and Republican county clerks who process licenses upstate.

    Surrounded by the county clerks, Assembly Minority Leader James Tedisco (R-Schenectady) accused Spitzer of ignoring a 1995 law requiring license applicants to have a valid Social Security number. Under the new policy, Tedisco alleged, terrorists could obtain licenses to gain entry to airplanes and government buildings.



    "Governor Spitzer, follow the law or we will see you in court," Tedisco said.

    The policy change, which starts in December, doesn't require lawmakers' approval, Spitzer said last week. He also said giving licenses to "hundreds of thousands" of undocumented immigrants would lower insurance rates and boost traffic safety.

    Senate Majority Leader Joseph Bruno (R-Brunswick) disagreed with the governor Friday, pledging action on a new bill to require either "a Social Security number or proof of authorized presence in the United States" to be eligible for a driver's license.

    The measure is still being drafted but will include elements of a bill from Sen. John Flanagan (R-East Northport) that called on DMV to obtain proof from applicants that they are ineligible for Social Security cards. Such proof generally can only be obtained by legal residents. Flanagan's legislation was adopted by the Senate earlier this year but never taken up by the Assembly.

    The Senate reconvenes Oct. 22.

    Spitzer's policy would allow license applicants to use a foreign passport and other documents to prove identity instead of a Social Security number.

    Spitzer spokesman Christine Anderson replied that "those who are suggesting lawsuits or legislation fundamentally misunderstand the law ... gives the DMV commissioner broad discretionary powers to determine what documents are required" to obtain a license. "New York's highest court has upheld the DMV commissioner's authority to administratively change these requirements," she said.

    The 1995 law at the center of the controversy was part of a federal initiative to crackdown on deadbeat parents.

    Assemb. Speaker Sheldon Silver (D-Manhattan) wasn't available Friday, but has endorsed Spitzer's plan.

    Separately, Sen. George Winner Jr. (R-Elmira), chairman of the Senate investigations committee, complained Friday that its Choppergate probe was being thwarted by the Spitzer administration.

    He threatened to subpoena e-mail and other records from gubernatorial aides who planned to discredit Bruno.

    Spitzer spokesman Jeffrey Gordon shot back that three investigations had cleared the aides of criminal wrongdoing.

    Spitzer wouldn't be trying to make it possible for Hillary to get more votes next year, now would he? These are the games the Clintons play. Bill did the same thing. Hillary said she was in it to win it. Looks like she will stop at nothing.

    Governor offers his most strident defense yet of his move to allow illegal immigrants to obtain drivers' licenses.

    Gov. Eliot Spitzer slammed his critics Monday and delivered his most strident defense yet of his move to allow illegal immigrants to obtain drivers' licenses.

    He blamed an "element of the far right that wants to demagogue this issue and create fears" in a thunderous speech before about 150 people gathered for the state Democratic committee's organizational meeting in Garden City.

    A tempest of debate followed his announcement that he'd move to allow those without Social Security cards or immigration documents to apply for licenses, and the state has sent out thousands of letters informing selected motorists of the policy.



    He blasted "those very folks in Washington who for years" failed to use their power to "enforce the borders" of the nation but "now...want to use the power of the poll and the worst demagoguing I've seen since I've been governor to create fears that are wrong and unwarranted."

    Spitzer and state Attorney General Andrew Cuomo acknowledged each other in their speeches. They crossed paths, but did not personally greet each other or shake hands as Cuomo took to the podium at the Garden City Hotel following Spitzer's speech to address the gathering. Cuomo said later he was prepared to defend the policy in court and when questioned by reporters said there is no tension between him and the governor to speak of.

    Before the partisan audience, Spitzer invoked the name of Gov. Al Smith whom he praised in particular for defending the rights of immigrants.

    Nassau County Executive Tom Suozzi said he supports the license policy. Suffolk County Executive Steve Levy, who opposes it, also spoke and prised the party and Spitzer.
