WALKER COUNTY ,Ala. (WIAT) — An illegal immigrant is being held behind bars on Friday night after he was involved in a fatal crash.
The 17-year-old is already being charged as an adult, and the District Attorney’s office says his charges may be upgraded to manslaughter.
Manuel Gutierrez was arrested on Tuesday and charged with assault and fleeing the scene of a crime.
Two motorcyclists crashed into Gutierrez as he pulled into oncoming traffic on Highway 118 after leaving Arrow Road.
The Walker County District Attorney’s Office says his charges could be upgraded to manslaughter or vehicular homicide, depending on the results of the autopsy.

JASPER, Alabama -- Jasper police have arrested a 17-year-old undocumented immigrant in a deadly motorcycle wreck last week.
Manuel Gutierrez was arrested Tuesday and is charged with first-degree assault in the May 10 collision between the car police say he was driving and two motorcycles on Highway 118, the Daily Mountain Eagle reported Friday.
The newspaper reported that Gutierrez pulled into oncoming traffic from Arrow Road and hit the two motorcycles. Darren K. Wilcock, 42, of Pineywoods, was on one motorcycle and was taken to UAB Hospital, where he died Tuesday.
Timothy Pate, 43, and his wife Dana, 41, of Townley, were on the other motorcycle and were both treated and released from UAB.
Jasper Police Chief Connie Cooner Rowe told the newspaper that Gutierrez was "unlicensed, undocumented and uninsured" and did not speak English.
Walker County District Attorney told the Daily Mountain Eagle that Gutierrez could face manslaughter or even murder charges. Wilcock died after Gutierrez was arrested.
The newspaper reported that federal immigration officials assisted local law enforcement in the investigation.

A 17-year-old illegal immigrant has been arrested in connection with a fatal crash that happened late last week in Jasper.
Manuel Gutierrez was arrested Tuesday and charged with first-degree assault. Despite being 17, Gutierrez is being charged as an adult.
Two motorcycles crashed into the car Gutierrez was driving Friday night when he pulled into oncoming traffic on Highway 118, after leaving Arrow Road.
Jasper Police Chief Connie Cooner Rowe described Gutierrez as “non-English speaking, undocumented, unlicensed and uninsured at the time of the crash.” She said he was not taken into custody at the scene due to a “language barrier issue” as well as conflicting reports over who was driving the vehicle once the suspects were located.
Darren K. Wilcock, 42, of Pineywoods was driving the first motorcycle that crashed into Gutierrez vehicle. He was airlifted to UAB Hospital, where he died Tuesday evening. Timothy, 43, and Dana, 41, Pate, of Townley were on the second bike to crash into the car. The husband and wife were transported by Regional Paramedical Services to UAB and have been released.
Rowe said Gutierrez was arrested prior to Wilcock’s death. She anticipates charges will be upgraded as a result of the death.
Jasper Police Sgt. Joseph Homan and Officer Will Wickwire worked the accident and have led the investigation with help from JPD Investigator Jimmie Vann. Jasper police have requested assistance from the Department of Public Safety’s Traffic Homicide Division.
Rowe said the United States Immigration and Naturalization Service was in Jasper Monday assisting with the investigation. INS has also placed a hold on Gutierrez.
Walker County District Attorney Bill Adair said charges could be upgraded to manslaughter or possibly murder. Adair has requested an autopsy.
“We will review the medical evaluation, as well as other evidence in the case, before determining what the charge will be,” Adair said. “We will review everything closely and possibly present this to the grand jury.”
Gutierrez was initially held overnight in a juvenile detention center, but after being charged as an adult is now housed in the Walker County Jail.

Crash leaves three injured, one critical

Three people were injured in a late night crash Friday involving a car and two motorcycles.
The driver of the car was a juvenile Hispanic male, who Jasper police confirmed is in the United States illegally. Three motorcycles were traveling together on Highway 118 when the young man drove his vehicle into the roadway from Arrow Road. Police Chief Connie Cooner Rowe said two of the motorcycles hit the vehicle.
A male driver of one of the motorcycles was airlifted to UAB Hospital. Rowe said his last known condition was critical. Two passengers on the second motorcycle were also taken to UAB and treated for injuries sustained in the crash.
Rowe said the juvenile’s vehicle was inoperable after the accident, but he walked away from the wreckage and stood nearby in a crowd of people. Officers identified him as a person in the crash, because he had glass in his face. The young man did not speak English and an interpreter was brought to the scene.
Sgt. Joseph Homan said the juvenile was detained for a short time and given several traffic citations. Homan added the young man could face more charges.

Can't speak English ...can't read English .....and just think if he had a driver license he would never ever crashed into them and then hide with the crowd...did he have tears for those people..naw if he did it was for screwing up his Obama amnesty plan....I wish somebody would have drag him over to the wreck and say see what you did see the lives you have shattered see what you illegals keep doing in our country!
