No matter where you stand on the emotionally charged issue of illegal immigration, you have to wonder what state Rep. Lily Mesa, D-Manchester, and Susi Nord, D-Candia, were thinking when they introduced HB 404 – a bill to prohibit state and local law enforcement agencies from enforcing federal immigration laws.

They have, intentionally or not, created a lightning rod for opponents of a rational immigration policy while doing nothing to promote one.

This bill is completely unnecessary, as the courts already have settled the matter, barring further action at the federal level or a constitutional amendment.

This legislation stems from last year’s effort by police chiefs in Hudson and New Ipswich to arrest illegal immigrants on a charge of trespassing.

Not surprisingly, the arrests were thrown out of court on the grounds that states are not the proper venue for enforcement of federal immigration laws.

Beyond the question of jurisdiction is the obvious inappropriate application of the trespass laws, which historically have applied to specific properties, not entire states or nations.

The arrests in Hudson and New Ipswich were, by admission of the police chiefs involved, to make a point. The chiefs were frustrated by the failure of the federal government to stem the tide of illegal immigrants and decided to take action on their own.

While this kind of cowboy approach might get kudos on radio talk shows, it’s no way to enforce immigration policy. If every police chief unhappy with federal agencies decided to take matters into his or her own hands, chaos would reign.

That being said, a state law to prohibit such arrests is a rhetorical measure on the other extreme and a waste of legislative time. New Hampshire is hardly a hotbed of illegal immigration, with one of the lowest minority populations – legal or otherwise – among the 50 states. The ill-considered actions of New Ipswich and Hudson police chiefs had more to do with making a political statement than providing any practical benefit to their communities.

Both sides need to set aside their volatile rhetoric so that as a nation we can work toward a rational compromise – one that would recognize the need to control our borders while avoiding the specter of mass deportations along with the family and economic disruption that would result.

That solution needs to be found at the national level, without pointless posturing by police on one side or lawmakers on the other.
