    NASHVILLE, Tenn. (AP) -- The state attorney general has issued a legal opinion that a legislative proposal to make it a crime for illegal immigrants to accept pay for work done in Tennessee is unconstitutional.

    Attorney General Bob Cooper says in the opinion released Wednesday that the proposal would conflict with the Federal Labor Standards Act, which protects workers' rights to receive minimum and overtime wages.

    The proposal sponsored by Sen. Joe Haynes and Rep. Mike Turner, both Nashville-area Democrats, has been awaiting floor votes in both chambers of the General Assembly.

    The bill proposes requirements for illegal immigrants caught working in the state to forfeit earnings and property, face up to six months in jail and be fined up to $500.

    B.S. .... You are working ILLEGALLY!!!! The money is gained by breaking the law, just as money is gained by selling drugs. They confiscate drug money!!!!! How can these people start with an illegal activity and end up with, they somehow have a right to a certain wage or wages under this illegal activity. Sheesh!

    EVERYTHING that gets in the way of obtaining cheap labor has become UNCONSTITUTIONAL! They don't seem to worry about all the hundreds of govt. activities and intrusions that are unconstitutional. BIG, ever expanding, government is unconstitutional!!!

    1) How can you at the same time be barred from working when you are here illegally and at the same time be afforded rights under Federal Labor Standards Act, which protects workers' rights to receive minimum and overtime wages? How does that work? if that was true all illegals woudl have to do is claim protection under that and get minimum wages etc.

    2) Teh point of ill gotten gains is sound in my opinion. You don't get to keep gains from selling drugs are stealing etc. So too your gains from working illegally ought to be confiscated!

    What's different here?

    If you are "aiding and abetting illegal immigration" it is against federal law. I don't know where this guy is coming from.

    A state senator reported a representative of a CHAIN of Mexican restaurants applied for a liquor license and listed the social security number as 123456789. Can you believe that???

    Does the same hold true for prostitutes?

    After all, prostitution is illegal in the US (well except at the government owned ranch in Nevada ). How come a person who accepts money for sex is penalized, but an illegal alien is not penalized for unlawfully working in the US?

    The prostitute isn't hurting anyone, right?

    Both expect to be paid for their "labor", so how come one is a constitutional right while the other is not?

    Maybe you should send your analysis to the attorney general along with the federals that states aiding and abetting is against the law.
