    A Latino advocacy group in New York has filed an international petition against the United States of America, charging that the government has fostered an anti-immigrant climate and then stood idly by as the human rights of Hispanics are violated.

    The allegations were brought by LatinoJustice PRLDEF -- a New York City group formerly known as the Puerto Rican Legal Defense and Education Fund -- in a petition before the Inter-American Commission on Human Rights, which is part of the Organization of American States.

    The petition is based on the cases of eight Hispanics, including three who died as a result of brutal attacks, as well as the bias incidents that have affected "other unidentified or unknown victims of hate crimes targeting Latinos and/or undocumented immigrants."

    In one of the most recent cases, José O. Sucuzhañay, an Ecuadorean immigrant living in Brooklyn, N.Y., was beaten with a bottle and baseball bat earlier this month by men shouting anti-Hispanic and anti-gay slurs. He died from his injuries.

    In essence, the filing seeks to shame the federal government before the international arena of public opinion over what the group says is the anti-Hispanic rhetoric and aggressive enforcement tactics that surfaced out of the immigration debate.

    None of the original petitioners are from Florida, but the case seeks to represent Hispanics affected by hate incidents anywhere within the U.S. territory. The group said it is seeking to partner with organizations throughout the country to embolden its case.

    The petition alleges that "The United States is failing to meet its obligation to ensure the security of Latinos who are residing in the United States."

    "Latinos," the filing goes on, "are being targeted, attacked, brutalized and murdered because of their race and ethnicity, and increasingly because of their perceived immigration status in incidents with rising frequency and severity throughout the United States."

    This appears to be the first case of its kind against the U.S.

    LatinoJustice President César Perales told me that his group decided to pursue this route out of frustration with immigration policies and the ensuing hate crimes.

    By ignoring the problem, Perales said, the United States is violating the very human rights it has defended as an essential part of democracy all over the world.

    "There is no legal remedy in our courts to do anything about the climate of opinion that has led to these violent attacks against Latinos," Perales said. "Our petition says that the U.S. government has failed in its basic responsibility to protect the safety of the residents of the United States and that there is a particular class of residents, Latinos, who are not being protected."

    The case cites the well-documented rise in hate crimes against Latinos as well as the George W. Bush administration's step-up in immigration enforcement -- an approach that, according to the filing, started in Florida as local police agencies entered cooperation agreements with U.S. Immigration and Customs Enforcement as early as 2002.

    It all creates a perception, said Perales, where undocumented immigrants --and Hispanics who are thought to be in the country illegally-- are seen as having no right to live in this nation.

    "The Declaration of Human Rights has nothing to do with legal residents. It refers to rights that you have because you are human beings and as such you have the right to be safe," Perales told me.

    The petition asks for the Commission on Human Rights to 1) Hold hearings to examine the allegations; 2) Launch an investigation into cases where the human rights of people have been violated because of their Hispanic ethnicity.

    Perales said that all the group wants is for the U.S. government to acknowledge the problem and agree on a corrective plan to stem the tide of hate.

    The U.S. has yet to formally respond to these allegations.

    As an American I demand that an international petition be filed against the USA charging that our government has fostered an anti-American climate and then stood idly by as the human rights of Americans are violated by illegal alien Hispanics and their special interests.

    Hmmmm........interesting. We Americans have the same complaint against our government in regards to those here illegally. Why aren't they doing more to protect us against the illegal aliens that drive drunk on our highways, rape, molest, rob, and murder our brothers, sisters, wives, children, etc.? I realize every illegal can't be painted with the same brush. However, one fact remains consistent in this mess, and that is that no illegal alien has the right to be here!

    This is just another weak attempt at obfuscating the real issue, illegal immigration.

    Exactly my point MW!!!

    What I want to know is WHY no one.....NO ONE.....has stepped forward in similar fashion on our behalf?

    I mean........take the issue of obama's eligibility for instance. I am in no way diminishing the efforts on such an important issue, but attorneys and everyone else have literally bombarded the courts over this issue yet there has never been one effort to protect Americans in the same way which these special interests utilize our system to protect IAs.

    A civil rights legal advocacy group, LatinoJustice PRLDEF, filed an unusual international petition Thursday accusing the United States of failing to adequately protect Latinos living within its borders, regardless of citizenship.

    The claim was filed with the Inter-American Commission on Human Rights, an organ of the Organization of American States, of which the United States is a founding member. It charges that the United States is failing to live up to the group’s declaration on human rights, the American Declaration of the Rights and Duties of Man.

    It cites violence against Latinos, including the murders over the past five months of three immigrants: José Sucuzhañay in Brooklyn last week, Marcelo Lucero in the Long Island town of Patchogue on Nov. 8, and Luis Ramirez in Shenandoah, Pa., on July 14. In all three cases, prosecutors say the assailants used anti-Latino slurs. Hate-crime attacks on Latinos rose 40 percent between 2003 and 2007, the petition says, citing the Federal Bureau of Investigation.

    The complaint also cites the rising use of agreements that allow local communities to deputize their police forces to carry out immigration law. They were created after Sept. 11, 2001, to increase cooperation between local police departments and federal immigration authorities.

    The group argues that deputization leads the police to treat all Latinos as suspects of immigration violations, engenders mistrust of the police among Latinos, divides communities and promotes a belief that Latinos can be attacked with impunity. The complaint notes that such an ordinance was adopted in Shenandoah and was under consideration in Suffolk County, where Patchogue is situated.

    The United States has not recognized the commission’s decisions as binding, but has sometimes responded to them in the diplomatic arena, lawyers at LatinoJustice say. In order for the petition to go forward, the commission must determine that the plaintiffs have exhausted all domestic legal remedies.

    Good grief, these people pick a name out of no where and then think they have authority in this country to demand what ever they want...

    "Organization of American States" who the hell are these people?...excuse me in the United States we elect the people who represent us, we the citizens live in a sovereign nation, usurpers like you can not just walk in and make demands to change our country with out Americans getting a little upset...soooo you know what you can do with your organization?

    The msm is fond of manipulating the terminology when it wants to, so are the "activists" when it suits their purposes.

    When BOTH the suspect and victim are hispanic, the msm will often call it a white on hispanic or black on hispanic crime.

    When the suspect is hispanic and the victim white, it's called a white on white or white on black crime.

    When the suspect is non-hispanic and the victim hispanic, you guessed it, it's a anyone on hispanic crime.

    I wonder what they would call a crime committed by a guatemalan against a mexican and racial slurs are tossed back and forth? Do they call that a "hate crime" too? If not, why not?

    The US protects "Latinos, regardless of citizenship", a whole lot better than they protect Americans from those "Latinos, regardless of citizenship"!!

    I wish Judical watch would file a similar lawsuit on behalf of dead Americans killed by illegals.
