Four Oaks, N.C. — The driver who hit and killed a Johnston County 7-year-old on Sunday night has been positively identified by the North Carolina Highway Patrol as Hipolito Hernandez, 30, of Parktown Road in Four Oaks.
State troopers said Marcus Lassiter, 7, was trying to cross Heath Road when a car driven by Hernandez struck him on Sunday.
The child’s leg was broken and he had brain damage.
Lassiter's aunt, Mary Ann Cooley, said the family made the decision to remove Marcus from life support, and he died late Monday night.
Hernandez orginally gave a false name to the arresting officers, but troopers who had dealt with him before recgonized him and were able to identify him, highway patrol spokesman Lt. Everett Clendenin said.
The suspect has used several aliases with different birth dates and middle names, so the highway patrol is hoping federal immigration authorities can help with more definitive information, including whether the man might have been in the country illegally.
Hernandez faces charges of felony hit and run, driving while impaired, driving without a license, driving a stolen car and causing serious injury with a motor vehicle. He remained in jail Wednesday, held on a $1 million bond.

The state Highway Patrol has identified a suspected drunken driver accused of striking and killing a 7-year-old in Johnston County as Hipolito Zamora Hernandez, 30, of Parkertown Road in Four Oaks.
The man previously told officers that his name was Pollo Hernandez Rodriguez.
Authorities learned the man's real name from several sources, patrol spokesman Lt. Everett Clendenin said this morning.
Hernandez is charged him with felony hit-and-run, felony assault, driving while intoxicated, possession of a stolen vehicle, driving without a license, speeding and reckless driving in the death of the child, Marcus Lassiter of Selma.
The patrol plans to consult with the Johnston District Attorney's Office about possibly charging him with second-degree murder, as well.
Marcus was struck near Four Oaks on Sunday and taken to Duke Hospital, where he died Monday night, Trooper D.B. Finch said.
The patrol said Hernandez' blood alcohol content when he was arrested was 0.21, more than twice the legal limit of 0.08.
State records indicate that Hernandez has been charged four times in the past with drunken driving in Johnston County.
One DWI charge, filed in March 2007, is still pending, and two others -- in 2004 and 2005 -- were dismissed. In the remaining case, in 2006, Hernandez was convicted of reckless driving to endanger, for which he paid a $25 interpreter's fee and $210 in court costs and fines.
He also was charged in February 2005 with having an open container of alcohol in his vehicle and in May 2005 with giving fictitious information to a law enforcement officer. He was not convicted of the offenses.
"Obviously, we are dealing with someone who is not paying any attention or respect to North Carolina laws," Clendenin said. "Hopefully now, we can take proper actions."
Clendenin also said the patrol is working with federal immigration officials to determine whether Hernandez is in the country legally.
He is in the Johnston County jail in lieu of $1 million bail.

An American citizen is given and automatic jail sentence AND a bigger fine after the 2nd DUI! This scum got off FOUR times and killed a child the FIFTH time?

My one and only DUI cost me almost 5,000 and a night in Jail and driving rights suspened for 90 days .. and Alchols classes for 5 months..
I guess I should have just giving thi=em a false name and pretened not to speak english..
This is not the case I have heard of where they just let them go to do it again and again .. I learned and I must say the hard way ..

How in the hell did this guy get two DUI charges dismissed! An American Citizen would have been convicted and doing some jail time.
