Man Charged with Raping 10-Year-Old Headed to Trial

A mother and her boyfriend charged in connection with the rape of a ten-year-old St. Anthony girl appeared in court Tuesday. This is the case where the young girl got pregnant and delivered a baby a few months ago.

The man and woman charged with crimes connected to this unusual case of a very young child having a baby both pleaded not guilty and are headed to trial.

Tuesday morning, 37-year-old Guadalupe Gutierrez-Juarez, the man charged with three felony counts of rape, waived his right to a preliminary hearing in front of Magistrate Judge Keith Walker.

The accused kept his face hidden the entire hearing while a court interpreter translated what was being said.

He's suspected of having sex with a ten-year-old girl, beginning back in August 2007. The child became pregnant. The pregnancy was discovered in April after the child went to a local medical facility ready to deliver.

Gutierrez-Juarez had his arraignment in District Court where he told Judge Brent Moss that he was not guilty of the charges. If convicted, he could be sentenced to three consecutive life sentences.

The ten-year-old girl's mother, 27-year-od Isabel Chasarez, is charged with felony child endangerment for allegedly knowing that her daughter was pregnant and not getting the proper prenatal care.

She faces up to ten years in prison if convicted.

She tearfully told the judge, through an interpreter, that she is not guilty.

The Fremont County Prosecutor's Office said they need at least two months to prepare for this trial. Judge Moss said he'll set the trial to take place within three to six months.

Meanwhile, both suspects will stay in jail. Gutierrez-Juarez will not be released because he is an illegal immigrant.

The St. Anthony Police Department says that the baby and the ten-year-old mother are still in the custody of the Department of Health and Welfare and that the baby, now 2 months old, is said to be doing great.
