Ex-Norwalk cop sued by unlicensed driver for patrol car accident

NORWALK-- An illegal immigrant is suing a former Norwalk Police sergeant for injuries she suffered during a 2008 accident, even though she does not have a driver's license and was found to be at fault in the accident, according to court documents and legal counsel for the city of Norwalk.

    M. Jeffry Spahr, deputy corporation counsel for the City of Norwalk, called the case "incredible" and the first of its kind that he's seen, stating that his "jaw just dropped" when he discovered the immigration status of plaintiff Angelica Llanos. Spahr admitted that Llanos has the right to legal recourse, but he disputes her version of events and said the lawsuit is without merit.

Llanos' attorney Bruce Corrigan Jr. did not return calls for comment.

Llanos is suing the city of Norwalk and former Norwalk Police Sgt. Ronald Pine for an accident that occurred in front of the entrance to the police station parking lot. She says that Pine sped from Elizabeth Street across South Main Street without stopping in an attempt to get to the parking lot and his haste led to an accident in which Llanos was injured.

She claims that her injuries were the result of Pine's negligence, as he failed to grant right of way and was operating his vehicle at an unreasonable rate of speed with consideration to the conditions at hand.

The lawsuit claims that she suffered sprains to her knee and cervix, headaches and permanent damage to her neck as a result of the accident.

Spahr admits that Llanos' immigration status and the fact that she does not have a license merely bring her credibility into question, and they are not in any way a defense.

However, he says the version of the events detailed in the lawsuit differs from the police report about the accident.

Spahr said that Pine had to cross two lanes of traffic to get into the parking lot and a car had stopped in the first lane. He said Pine paused at the double yellow line, looked down the street and saw that Llanos was "stopped or seriously slowed" before he decided to make his way across the lane and into the parking lot, according to Spahr.

After the accident, Llanos told police that she was looking at a Columbian bakery on the other side of the road and failed to realize that Pine was driving across the street, Spahr said. Llanos was ticketed for driving while distracted and driving without a license.

"She was apologetic when she hit the (patrol) car," Spahr said.

Although police reports state that Llanos admitted that she was looking at the bakery when the accident occurred, Llanos said during deposition that she was not looking at the bakery, according to Spahr.

At the scene of the accident, Llanos refused medical treatment twice and only agreed to be evaluated on scene when an officer noticed a bruise on her hand and asked her to stay until an ambulance arrived, Spahr said.

During deposition, Llanos admitted that her work visa expired in 2004, and she never tried to renew it, Spahr said. She also admitted to never being a licensed driver, even when she lived in her native Columbia, according to Spahr.

The case has not yet been slated for trial, and Spahr is still taking depositions from witnesses.

She shouldn't have a leg to stand on, with no license she shouldn't have been on the road. The accident was HER fault. But with the crazy judges we have these days, she will probably win.

Well if they would have deported her ass right away she wouldn't have had time to be thinking about phoney law-suits. I hope this back-fires big time on her and she get deported Pronto.

At this point, the judge, the prosecutor, the defense attorney, the litigation lawyer, the stenographer, the bailiff, the court clerk..etc..etc..all are on the Obama/Eric Holder Pay roll.
Its all set up now. Just the way they want it.
