The Mexican government is warning that Texas’ denial of birth certificates for U.S. children born here to undocumented immigrants stands to imperil the relationship between Mexico and the Lone Star State.

The concern was raised in an amicus brief filed Monday evening to lend support to immigrants parents who sued Texas after being denied birth certificates for their U.S.-born children, even after showing their “matrículas,” the ID cards issued by the Mexican consulate to undocumented immigrants.

Mexico says the practice stands in stark contrast to the historical practice among countries to accept passports or other forms of ID to issue birth certificates.

[It] not only jeopardizes their dignity and well-being, but could threaten the unique relationship between Mexico and Texas, the Mexican government said in a brief tied to a lawsuit filed against the state by Texas Civil Rights Project and Texas Rio Grande Legal Aid.

The lawsuit, the Texas Tribune reported,http://global.fncstatic.com/static/v...ernal-link.png was filed on behalf of six U.S. citizen children and their undocumented parents, who came from Mexico, Honduras and Guatemala. Other groups since have joined the suit.

A main point of contention is the all-out refusal at some county registrars offices to accept as a valid form of ID anything short of a U.S. visa or consulate ID card, the Tribune said.

The families who are suing say that Texas is violating the 14th amendment and that the state is superseding federal immigration laws.

Texas officials are claiming sovereignty issues and argue that the United States cannot fight them.

They long have said that consulate-issued identification cards are not considered reliable forms of ID.

The Mexican government is requesting that Texas be clear about what two forms of ID it will accept in order to give the children U.S. birth certificate.

“Our argument isn’t ‘yes matrícula, no matrícula,’” said attorney Jennifer Harbury, who represents the families, to the Tribune. “The argument is ‘what will you take that people can actually get?’ They have to take something. [The children] were born here. They are U.S. citizens.”

The amicus brief also claims that denying the children U.S. birth certificates blocks their claims to Mexican citizenship. A child born to Mexican parents has that right but must show proof of identity. Infringing on that is a violation of international law, the brief states.

Mexican Consulate officials argue that the matricula is, in many ways, more secure because it includes biometric technology, unlike the driver’s licenses in some states.

They say a parent’s undocumented status should not affect a child’s ability to obtain a birth certificate.

“We think that they are not immigration authorities,” he said. “The passport is the official way to identify oneself.”

Mexico fights hard and has money to spend on lawsuits to make sure it's citizens get all they can get in the states.

I hope that Texas prevails against the threats and lawsuits from Mexico. Our federal government is worthless when it comes to illegal immigration and protecting our states and citizens from Mexico and its meddling.

If they don't have the Texas birth certificate, they can't get the welfare money....

Exporting their population is big business in Mexico and they don’t like it when uppity governors start interfering with their income and the associated acquisition of the United States by invasion. They had a sweet deal going with Obama, Jeh Johnson and the open border fascists, a deal that Texas and Donald Trump are now forcing into the negative light of day.

The Texas Tribune, reported in a Tuesday article, that the thugocrats in Mexico have issued a warning to the State of Texas, that denying their citizens their supposed “right of invasion by birth” could imperil the relationship that state has with its parasitic neighbor to the south.

The Mexicans are so upset and perhaps more than a little worried, that they filed an amicus brief on Monday in support of a group of anchor baby parents, whose plans to strong-arm U.S. citizenship for their third-world peasant spawn have hit a snag. Texas has refused to issue birth certificates to foreigners born in their state despite being presented with worthless “Mexican matricula” ID cards.

Those ID’s are issued by the Mexican consulates as a means of establishing identification for lawbreaking invaders who are not able to get legitimate identification in the United States. They are issued upon what is at best a cursory verification of identity and information, one largely based upon the word of the recipient that the information is true and accurate. The stated purpose of the cards is to demonstrate that the bearer is a Mexican who is residing outside of their country, regardless of whether they are doing so legally or illegally.

Mexico is claiming that the refusal of Texas to accept the meaningless IDs and to exchange them for the prized American citizenship violates a longstanding practice of honoring passports “or other forms of ID” to issue birth certificates. That’s quite a broad argument they make, and one which needs to be challenged simply because of its absurdity if nothing else. That is a far different standard than the one Mexico holds itself to.

They argued, “[It] not only jeopardizes their dignity and well-being, but could threaten the unique relationship between Mexico and Texas.” That’s a unique arrangement not unlike the “unique” arrangement Mexico has with every other state in the nation, one in which they flood their peasants in and we subsequently provide them with a free ride which often includes undeserved citizenship for their children.

As for their dignity, the dignity of lawbreaking sponges that violate our laws in order to freeload on the backs of the American citizens should not be a concern. If they want dignity and respect, they can return home and work while they await the legal immigration process.

The lawsuit was brought by agitator organizations on behalf of six plaintiffs and has twice been amended. It now includes thirty parasitic families. One has to wonder, at what point do the deniers who continue to argue that Mexico is a friendly nation begin to recognize a hostile invasion when they see one?

The arguments made by those representing the invaders are based upon the interpretation of the 14^th Amendment as guaranteeing citizenship to anybody fortunate enough to have been geographically positioned within our borders at the time of their birth, regardless of the criminality which placed them there.

They argue that Texas has violated the 14th Amendment’s Equal Protection Clause by rejecting the often-fraudulent documents as well as the Supremacy Clause by enforcing federal immigration laws.

The Texas Attorney General sees things differently. In their representation of the Health Services Department, they have asked that the court dismiss the suit based upon the 11^thAmendment. That amendment reads, “The judicial power of the United States shall not be construed to extend to any suit in law or equity, commenced or prosecuted against one of the United States by citizens of another State or by Citizens or Subjects of any Foreign State.”

That could or at least should rule out federal intervention on behalf of foreigners in the issuance of Texas birth certificates, and without the issuance of a birth certificate stating the plaintiffs to be Americans, all plaintiffs are foreign nationals.

Texas cites their not having waived protection under the 11^th Amendment and its sovereign immunity provision, in their request for dismissal of the suit.

They also note that the State Health Services Department has never considered matricula cards to be a secure document for purposes of obtaining a vital record. Some counties had accepted them in the past, but the practice has since been discontinued.

The Mexican government is requesting that Texas clarify what forms of ID are acceptable, so they can help their citizens get on with the invasion.

Oddly and rather disingenuously, Mexico is also arguing that the failure on the part of Texas to issue American birth certificates prevents the children from being able to obtain their Mexican citizenship. It is unclear why Mexico couldn’t simply issue one of those cure-all magic matricula cards to each of their citizen children to correct that problem and then present them to themselves for a passport.

Maybe it’s because that is a phony argument and it’s all really about the invasion, period.

Granting of citizenship is a completely domestic matter and Mexico needs to withdraw its amicus brief from the lawsuit or face the biggest fvcking boycott in the history of the planet.

You see that something is or have reason to believe something has been made in Mexico, don't buy it.

GO TEXAS! And someone needs to find out why those 2 stupid counties aren't joining all the rest in this effort. Republicans in every "red state" need to demand their states join with Texas and stop issuing birth certificates.

By the way, how does a "county" issue a State certified birth certificate to begin with? I thought the states did this, not counties.

NO. Only 2 counties are refusing to issue birth certificates. The state isn't involved in the lawsuit. Only 2 counties.

What is helping make it confusing is that the certificates say Texas on them but it was COUNTY offices that refuse to issue them. The state wasn't really involved in not issuing them, just the 2 county offices.

Texas Attorney General Ken Paxton on Wednesday asked a federal district judge to dismiss a lawsuit that claims a state agency violated the U.S. Constitution by denying birth certificates to U.S.-citizen children of immigrant parents.

Attorneys with Paxton’s office said that the Texas Department of State Health Services, which is being sued by 17 families living in Cameron, Hidalgo and Starr counties, has sovereign immunity under the 11th Amendment and cannot be sued in federal court because it has not waived that right, according to court documents.

The immunity extends to interim DSHS Commissioner Kirk Cole and State Registrar Geraldine Harris, who are also named as defendants in the suit, Paxton's office argues.

A spokesperson in Paxton’s office would not discuss the filing further, saying the “motion speaks for itself.” A spokesperson for the health agency was not available to comment.

Attorneys with the Texas Civil Rights Project and Texas RioGrande Legal Aid sued the agency in May on behalf of six U.S. citizen children and their parents, who are undocumented immigrants from Mexico, Honduras or Guatemala. In an amended June filing the number of plaintiffs rose to 17 families.

The families claim that the agency is violating the 14th Amendment’s Equal Protection Clause by denying birth certificates to children who are, in fact, U.S. citizens.
Local vital statistics offices, which are overseen by DSHS, have refused to accept what the families argue were once acceptable forms of IDs for non-citizens, including passports and Mexican matrícula cards issued by the Mexican consulate offices throughout Texas.

“Such refusal is de facto based on the immigration status of the Plaintiff parents. The lack of a birth certificate, in turn, is causing serious harm to all plaintiffs,” the June filing states.

According to the DSHS website, non-citizens can request birth certificates if they have two secondary forms of identification, including a Mexican voter registration card or a foreign ID card with a photo of the applicant. Foreign passports are also acceptable if they have a valid U.S. visa, which attorney Efrén Olivares said excludes his clients because they are undocumented.

The families also claim the state is improperly enforcing immigration laws, a responsibility belonging to the federal government.

In a statement to the Texas Observer this month, a DSHS official said the agency accepts several forms of ID to verify identity but not the matrículas consulares because the documents used to obtain them are not verified by the “issuing agency.”

The issuing agency is the United Mexican States, attorney Olivares said.

“I would be curious to see if a similar ID issued from Canada” received the same response, he said.

Olivares and lead attorney Jennifer Harbury also argue that if the state changed its policy, it did so without alerting the public or going through an official process.

According to the court filings, plaintiffs Diana Hernandez and Javier Reyes, Mexican citizens who moved to Texas more than a decade ago, received birth certificates for their children in 2009 and 2010 after showing their matrícula cards. They tried again in January after their third child was born and were denied.

Harbury said Wednesday afternoon that her team would file a response after reading the state’s motion. The problem appears more widespread than just the families in the lawsuit, she said.

“What I know is there is a very large number of people who are afraid to come forward,” she said.

Immigrants’ kids sue Texas

WESLACO — Immigrant families seeking birth certificates for their children born in the United States have been spurned in recent months by Texas officials who refuse to recognize as valid Mexico consular-issued identification, according to a civil lawsuit filed Tuesday in U.S. District Court in Austin.

Attorneys representing six U.S.-born children and their parents allege the Texas Department of State Health Services denied birth certificates to children on the border whose parents lack citizenship or legal status.

“Clearly, the intent here is to deny birth certificates to citizens who are born to mothers who don’t yet have a valid immigration status,” said Jennifer Harbury, an attorney with Texas Rio Grande Legal Aid. “They are discriminating against the U.S.-born children to punish them for the way the parents entered the country.”

The civil suit, filed by the legal aid group and the Texas Civil Rights Project, contends that an internal policy of the Texas Department of State Health Services has directed its employees along the border to decline as acceptable an identification card, known as the Matricula Consular, issued by Mexico through its consulate offices. The suit asks for a declaratory judgment or an injunction that blocks the state policy.

Attorneys also contend the state is interfering with federal immigration policy.

The state agency Wednesday said its policy to require more than the Matricula Consular to verify identity has been in place since 2008.

“U.S. Citizenship and Immigration Services and other federal agencies do not recognize (Matricula Consular) as proper identification or consider it to be a reliable form of identification,” said Carrie Williams, spokeswoman for health services agency. “This is largely because the issuing consulate doesn’t verify or authenticate source documents.”

Attorneys for the families say the state never enforced its policy until last year when a surge of pregnant women and unaccompanied children fleeing Central America poured into the Rio Grande Valley.

Soon after, people from Brownsville to El Paso said officials with the Vital Statistics Unit, the state office responsible for issuing birth certificates, began denying the applications of immigrant parents in the country illegally.

It can be difficult for undocumented immigrants in Texas to demonstrate parentage for the purpose of obtaining a birth certificate. A parent must prove legal status in the country or provide a current voter registration card, which many people do not have.

Without a birth certificate for their children, parents face significant barriers to enroll them in school or give consent for medical care.

A citizen may request his or her own birth certificate with a driver’s license, or a Social Security card and recent utility bill, for example, but to acquire those documents often calls for a birth certificate.

“This is just the tip of the iceberg,” Harbury said. “There are many more families out there that haven’t gotten birth certificates for their children.”

The lawsuit comes as a panel of the 5th U.S. Circuit Court of Appeals ruled this week to keep on hold President Barack Obama’s immigration policies to shield up to 5 million immigrants from deportation and provide them with work permits.

Obama’s immigration plan also includes deportation protections for parents of U.S. citizens and permanent residents, which had been scheduled to begin May 19.

“A birth certificate is necessary to apply” for deportation deferral, said Efrén C. Olivares, an attorney with the South Texas Civil Rights Project. “Without it, a person has no proof that he or she has a U.S. citizen child and cannot apply.”

Texas is the lead state among 26 that sued to stop Obama’s expansion of immigration policies and has won a temporary injunction to block them.
