    ACLU to Appeal Fremont Immigration Ruling

    Hours before the Fremont City Council decides how to proceed with an ordinance originally designed, in part, to prevent illegal immigrants from living in town, the ACLU announced plans to appeal a judge's ruling and urged the council to delay implementation.


    Last week, U.S. District Court Judge Laurie Smith Camp struck down part of the ordinance and kept in other aspects.

    Both sides claimed victory.


    Experts say it will allow the city to charge for a permit if you want to rent and even submit information on your immigration status using E-Verify.


    But it's unclear what the federal government would do about it.


    The city would have to issue permits to everyone.


    Opponents of the ordinance say it would be a lot of work with no teeth.


    The ACLU contends the entire ordinance is an illegal use of city power and wants to argue that point at the next level of the appeal process.


    Fremont voters passed the ordinance in June 2010.


    The city council is expected to discuss its next move at a meeting Tuesday night.


    The ordinance could be implemented in 14 days.


    Supporters say they had to make a move on immigration since the federal government is not.
