    The US' H1B visa has frequently appeared in workpermit.com's news section, mainly related to the popular visa's quota of 65,000, which many in the high tech industry wish to raise.

    Although the quota hasn't yet been raised, we'd like to take a moment to remind you that if you are planning to apply for an H-1B visa, the time for submitting your application is approaching.

    US employers may begin applying for the H-1B visa six months before the actual start date of the visa. Since the beginning of the FY 2007 is October 1, 2006, employers can apply as soon as April 1, 2006 for the FY 2007 cap, but the beneficiary cannot start work until October 1, 2006.

    About the H1B

    The US H1B visa is a non-immigrant visa, which allows a US company to employ a foreign individual for up to six years. As applying for a non-immigration visa is generally quicker than applying for a US Green Card, staff required on long-term assignment in the US are often initially brought in using a non-immigrant visa such as the H1B visa.

    Individuals can not apply for an H1B visa to allow them to work in the US. The employer must petition for entry of the employee.

    What about the 710,000 (2002 figures) now it’s over 1 million H-1B visa holders who forgot to go home (overstayed their 6 year visa)? Isn’t that enough for you and Tata?

    Why don’t you remind the 1 million + H-1Bs, who are here illegally, that it’s past time for them to go home to Bangalore?

    H-1Bs arrive --- US IT workers are coerced to train them --- US IT workers get FIRED
    H-1Bs arrive --- US IT workers (over 40) have to train them --- US IT workers over 40 get FIRED
    H-1Bs arrive --- Disabled US IT workers have to train them --- Disabled US IT workers get fired
    H-1Bs arrive --- Minority US IT workers have to train them --- Minoity US IT workers get fired

    Laws are being violated - the H-1Bs from India are under 40 years old, healthy H-1Bs replace disabled Americans, and H-1Bs who represent ethnic majority in India replace minority US workers.

    Yes they do apply, because the (to be fired) Americans know by name who their replacements are and they are summarily fired in favor of specific by-name replacements from India. Ask any of the 500 USAA programmers who got fired in January 2003 right after they trained their replacements from Bangalore.
