    A deadly assault described as a random act of violence has left a 45-year-old Albion woman dead and a Honduran national charged with murder, Orleans County sheriff's officials said today.

    Kathleen I. Byham was walking toward her car in the Walmart Super Center parking lot in the Town of Albion shortly after 7 p.m. Sunday when she was accosted and stabbed multiple times, Sheriff Scott D. Hess reported.

    Byham was taken to Medina Memorial Hospital, where she was pronounced dead at 7:40 p.m.

    A massive search, aided by K-9 dogs and a State Police helicopter, led to the apprehension of Luis A. Rodriguez-Flamenco, 24, identified by authorities as an illegal immigrant.

    He was charged with second-degree murder and sent to the Orleans County Jail without bail, following his arraignment before Albion Town Justice K.J. Howard.

    Two other men described as Mexican nationals and fellow illegal immigrants also were apprehended. While they accompanied Rodriguez-Flamenco to the Walmart, they did not participate in the attack, sheriff's officials said. They have been turned over to the U.S. Border Patrol.

    Authorities emphasized that they have no evidence suggesting that Byham and her attacker knew each other. Investigators believe the assailant targeted the woman only after she left the store and walked toward her car.

    Eyewitness descriptions and Walmart security video were crucial in the apprehension of the suspects, authorities said. The search involved numerous federal, state, county and local law-enforcement officers, including the state police, Albion police, the Niagara County Sheriff's Office and the Buffalo police.

    Another stupid senseless murder of an innocent American citizen.

    Obozo, Cuomo, Bloomberg all have the blood of this poor woman on their hands. All these people WANT the illegals here, they refuse to enforce our immigration laws and they bend over backwards to grant them every benefit known to man... all at OUR expense.

    ALBION — An illegal alien from Honduras was charged with murder for the vicious stabbing death of a shopper in the Wal-Mart parking lot Sunday night, a murder that appeared to be a random act, Orleans County Sheriff Scott Hess said.

    Luis A. Rodriguez-Flamenco was arrested after an all-night search by numerous police agencies. He was arraigned in Town Court and committed to Orleans County Jail without bail.

    Flamenco, 24, is accused of repeatedly stabbing Kathleen I. Byham, 45.

    Byham was shopping alone and had just left the store when she was approached by three men as she got to her car about 7 p.m.

    ‘‘She suffered multiple stab wounds to the torso,’’ Hess said.‘‘She was shopping by herself and was not with any of the three men.’’

    Byham, of Albion, was transported to Medina Memorial Hospital, where she was pronounced dead at 7:40 p.m.

    Several people witnessed the attack and were able to give police a description of the men, who took off running east toward the village of Albion.

    Two of the men were caught in separate homes in the village, about 90 minutes after the attack, Hess said.

    ‘‘We were able to locate them based on information we received,’’he said.

    The two men who were with Flamenco did not actively participate in the murder have not been charged. Hess said the two are illegal immigrants from Mexico and both have been turned over to U.S. Border Patrol.

    Hess said it was unclear what the motive was but investigators were looking at the possibility of an altercation inside the store or a robbery.

    ‘‘There is no evidence whatsoever to indicate that the defendant and the victim knew each other,’’ Hess said. ‘‘Sheriff’s investigators believe that the defendant specifically targeted the victim only after she exited the store and walked towards her car. This appears to be a random act of violence.’’

    The woman parked almost directly beneath a light pole in the middle of the parking lot. The pole also contained surveillance cameras, two which are pointed directly where the woman was stabbed.

    Police did review the video.

    The stabbing happened on a fairly busy Sunday night at Wal-Mart, which is just west of the village of Albion at Route 31 and Gaines Basin Road.

    During the hours after the stabbing shoppers came and went, some driving slowly past the site of the stabbing, which was cordoned off with yellow police tape.

    To the east a state police helicopter hovered over the area, searching for the third suspect. A Niagara County Sheriff’s Department K-9 unit arrived to assisted deputies, along with village of Albion police, Orleans Major Felony Crime Task Force and state troopers.

    Police on foot were concentrating on an area east of Wal-Mart.

    Patrol cars and unmarked police cars combed the area and parked at several intersections.

    Hess said the extra help was ‘‘invaluable’’ and the Wal-Mart officials were cooperative during the investigation.

    I'm sorry, if they were present during the murder and did nothing to stop it they are equally guilty!

    ALBION — The slaying of a woman at the Albion Walmart has renewed the debate over curbing illegal immigration.

    Luis Rodriguez-Flamenco, who was charged in the fatal stabbing of Kathleen Byham, was a Honduras resident who was in the country illegally.

    The U.S. Department of Immigration and Customs Enforcement deported nearly 400,000 individuals in the 2011 fiscal year, which ended in September. It also says 55 percent of those deportees had felony or misdemeanor convictions.

    They included 1,000 murderers, 5,800 sex offenders and 80,000 people convicted of drug-related crimes or driving under the influence of alcohol.

    Some groups, such as the Federation for American Immigration Reform, believe an initiative called the Secure Communities program could help weed out potentially dangerous people, among the estimated 11.2 million who reside in the US without authorization.
    In part it allows law enforcement agencies to run the fingerprints of people they arrest against immigration databases, aiming to find illegal immigrants.

    But over the summer, New York Gov. Andrew Cuomo suspended the state's participation in the program because of concerns about potential abuses. Some say he exercised proper caution, but others called the program an important safety tool.

    "Your governor has just scrapped plans for secure communities and has prohibited state police from using an important public safety tool for illegal immigration," said FAIR spokesman Bob Dane.

    "In any city in America I'll guarantee you one thing ... that tonight an officer will pull someone over in a car for a driving violation and in that car will be five people who don't speak English, nobody will have a driver's license, car registration, proof of insurance or Social Security numbers ... and at that point common sense would dictate that a law enforcement officer should check into immigration status," Dane said.
    "I am 100 percent for the enforcement of U.S. immigration law, but that's not the argument," said Buffalo-based immigration lawyer Matthew Kolken, who believes Cuomo prudently exercised caution. "The argument is that secure communities can be used to violate the rights of people who are United States citizens," Kolken told WGRZ-TV.

    Kolken says this can occur when someone — especially of color and who might have an accent — is stopped by police and can't readily prove their citizenship. He claims to know of several instances where this has occurred, and where citizens have spent hours — sometimes days — in custody while things get straightened out.

    Orleans County Undersheriff Steven D. Smith told WGRZ-TV that prior to his arrest for the killing of Byham during what police believe was an attempted car theft, Rodriguez-Flamenco was employed as a laborer by Panek Farms of Albion.

    Julie Suarez, director of Public Policy for the New York State Farm Bureau noted that farms, like any other employer, are obligated to secure a number of documents from those seeking work. These include a completed form (commonly called an I-9) in which the employee attests to their eligibility to work legally in the country.
    But she notes that documents can be forged and that farmers don't have the resources to prove their authenticity.

    "People will always find ways to circumvent rules," Suarez said.

    Suarez acknowledged the existence of a federal e-verify system designed to prove an individual's ability to work legally in this country, and says it does work better now than it did years ago.

    "However, there's still a central flaw in the system in that if an employee commits identity theft, without biometric identification documents, the employer is still left in a situation of potentially employing an individual who isn't legally authorized to work in this country," said Suarez in an e-mail to WGRZ.

    As well, Suarez says that even farmers who are suspicious of the authenticity of documents provided by potential hires can be hesitant to challenge them and deny someone a job for fear of being sued for discrimination.

    So what? A so called "citizen" spending a few days in custody because they weren't carrying identification, is certainly less intrusive than illegal invaders killing American citizens.

    BTW…any American (accent or not) would probably end up in jail if they were stopped and couldn’t prove beyond a reasonable doubt who they were! This is nothing more than hyperbole and hysterics in an effort to protect illegal invaders from Secure Communities!
