Warrant issued after man deported

JUNEAU | A warrant was authorized Thursday for a 33-year-old Beaver Dam man who failed to appear on charges of fifth offense drunken driving due to the fact that he had been deported.

Raymond Vargas Escobar is charged with his fifth offense of operating a motor vehicle while intoxicated with an enhancer for having a blood alcohol concentration of more than .20 and operating a motor vehicle with a revoked license. If convicted he faces up to seven years in prison.

Escobar was scheduled to make his initial appearance on Thursday. However, court notes state that Escobar failed to appear because he had been deported. A warrant was authorized by Judge John Storck.

Managing attorney Bob Barrington of the district attorney’s office explained that in general, felony cases have a statute of limitations of six years, with some exceptions. However, because the case has been filed and a warrant has been issued for failure to appear, the case can be heard whenever that warrant is fulfilled. The warrant will be in the system until the court cancels it or until Escobar is located and brought back to face the charges.

According to the criminal complaint, Escobar was pulled over in Beaver Dam on March 18, 2012, at 1:05 a.m. for a defective headlight. The officer noted that the driver, later identified as Escobar, had trouble rolling down the window and had red, bloodshot, glassy eyes. Escobar told the officer he didn’t have a license and gave the officer a different name.

The complaint states that Escobar was unable to complete the field sobriety tests.

Officers were able to identify him with the help of Jefferson County officers. A blood draw showed that Escobar had a blood alcohol concentration of .217.

He was previously convicted of OWI in 2002, 2004, 2005 and 2013.
