Man caught with pot back in jail

LEXINGTON – Omar Barba, a 35-year-old Chula Vista, Calif., resident, is back in the Dawson County Jail, even after posting bond of $100,000 at 10 percent.

According to information filed by the State of Nebraska, Barba was allegedly driving 95 miles per hour down I-80 near mile marker 219 when he was stopped and given a speeding summons by State Patrol Officer B. Bauer.

According to court records, Barba gave Bauer consent to search his vehicle. Bauer found a duffle bag that allegedly contained 24 pounds of marijuana in plastic bags.

Barba’s attorney, Ken Harbison, argued in Dawson County District Court that the search on Barba’s vehicle was not performed within accordance of the law and filed a motion to suppress the evidence.

Presiding Judge James Doyle denied the motion.

Barba posted bond and was free until he was picked up by Immigration and Customs Enforcement (ICE) and jailed there. Doyle ordered a Writ of Habeas Corpus (literally, “you have the bodyâ€
