    E-Verify Self Check Goes Live on March 18, 2011

    The United States Citizenship and Immigration Services (USCIS) has published a notice in the Federal Register announcing that the new E-Verify Self Check feature will go into effect on March 18, 2011. As previously reported, the E-Verify Self-Check initiative will enable individuals to check their work authorization status prior to being hired and facilitate correction of errors in the federal databases which E-Verify utilizes. Self Check was developed primarily to address concerns with the current employer-focused E-Verify process, where employees have very limited ability to identify, access or correct information that may ultimately lead to a tentative nonconfirmation (TNC). Self Check promises to provide an easy method for individuals to check their own employment eligibility status outside of the normal E-Verify process, and thereby reduce the likelihood of TNCs.

    How will Self-Check work?

    E-Verify Self Check will involve two broad steps (with a few others underneath): (1) Identity authentication of the individual and (2) an E-Verify query to confirm the individual’s current work authorization status. Here’s how it will work:

    Step 1 – Identity Check

    After browsing to the website, the individual will be asked to enter some basic identifying information, including name, address of residence, date of birth, and Social Security number (optional). After the information is entered by the individual, it will be submitted to a 3rd party identity assurance service (IdP) to generate a minimum of 2 “knowledge-basedâ€

    This is like making it possible for a bank robber to see if it's ok to rob a bank!

    While it sounds like money spent I also feel that any option or improvement to the database will also be a help to make this a powerful tool for employeers as well as Law Enforcement.

    The main improvement needed is a crosscheck between SS and IRS databases into the E-Verify system. If someone seems to be working at multiple locations in different areas at the same timeframe, seems to have 3+ jobs, or registered as deceased or recieving SS benefits of any sort should require an audit and flag if needed on the account.

    On Thursday, the United States Citizenship and Immigration Services (USCIS) held an engagement in Washington, DC to demonstrate the new E-Verify Self Check program and elicit stakeholder feedback. As previously reported, the E-Verify Self-Check online application will enable individuals to check their work authorization status prior to being hired and facilitate the correction of errors which might lead to a tentative nonconfirmation (TNC). Featuring a panel of E-Verify experts from the USCIS, the session provided an illustrative walk-through of the new Self Check process and the steps that USCIS has taken to ensure data privacy and protect against potential employer misuse. We also heard the plan for Self Check rollout and future enhancements coming in the next few months. Now, on to the specifics!

    Self Check Rollout

    USCIS is releasing the E-Verify Self Check service on March 21st (note the date change from our previous article) in carefully planned phases to allow for proper testing and feedback. Initially, the service will only be offered to individuals that maintain an address and are physically located in Arizona, Colorado, Idaho, Mississippi, Virginia, or the District of Columbia. According to the USCIS, these particular locations were chosen based on a variety of factors including E-Verify case volume (which is certainly higher in states with E-Verify laws such as Arizona, Mississippi, and Colorado) in addition to more practical concerns such as whether the local SSA offices are equipped to handle the additional workload of addressing social security mismatches.

    Now, you might ask, how will they be able to enforce the “physically locatedâ€
