Immigration Lawyer: No Self-Deport, Amnesty instead

    ICE’s new self-deport program

It’s no shock to anyone in our country that we have a problem with illegal immigration. What is shocking, however, is how our government, through a new ICE program, is now proposing to handle it. A recent ICE notice reads as follows:

It’s no shock to anyone in our country that we have a problem with illegal immigration. What is shocking, however, is how our government, through a new ICE program, is now proposing to handle it. A recent ICE notice reads as follows:

U.S. Immigration and Customs Enforcement (ICE) announced today the launch of a pilot program, Scheduled Departure, which will begin next week in five cities. The program allows fugitive aliens who have no criminal history and pose no threat to the community an opportunity to remain out of custody while they coordinate their removal with ICE.

The program complements ICE's Fugitive Operations Program which targets fugitive aliens for arrest and removal from the United States. ICE's fugitive operations teams give top priority to cases involving fugitive aliens who pose a threat to national security and community safety. There are 90 active fugitive operations teams, with 14 more scheduled to be deployed in the next two months. Fugitive operations teams will continue to carry out targeted enforcement operations throughout the country.

"This program addresses concerns raised by aliens, community groups, and immigration attorneys who say ICE unnecessarily disrupts families while enforcing the law," said Julie L. Myers, Homeland Security Assistant Secretary for ICE.

Initially, the Scheduled Departure Program will run from Aug. 5 to Aug. 22 and may be expanded. Participation in the program ends the risk of sudden arrest and detention for certain non-criminal fugitives. Those with families can particularly benefit from this program. It allows qualifying aliens to make removal arrangements without being held in custody, which will ease their transition and minimize the impact of their removal on their loved ones. In addition, ICE will allow eligible participants to arrange for their families to depart together, should they so desire.’’

What does this new program really mean and is it a good thing? It all depends upon your point of view. If you’re the government and want to try to clean up the approximate 572,000 ICE fugitives in the United States, including 457,000 who do not have criminal histories, maybe. If you’re an “ICE fugitiveâ€

Shouldn't that be "known criminal histories?"

The idea in making such an offer is to provide two things:
1). The relative 'luxury' of not having to be caught up in a raid and deported fast-track style
    and
2). Give some time to clean-up affairs before heading home.

Re: the 400,000+ of IAs that have pending deportation orders-but, in contrast with the author's characterization, by virtue of the fact they've absconded they are technically criminals. In other words, all 572,000 or so of the IAs with pending deportation orders are criminals - no fuzziness exists on the matter.

I loved the drama of a knock in the middle of the night and being ripped from the heart of the family. Does this attorney have an email because I would love to send her some of my thoughts about her being a traitor.

    A Simple Solution.

Simple solution: Revise the 14th amendment and grandfather in children born in t1964 and afterwards are not US citizens; enforce the immigration laws on the books, no benefits of any kind including emergency health- care and deportation. Send “Special Forcesâ€

ELE I think it unrealistic to get the politicians to exclude the anchor babies of voting age so that right now you would have to settle with excluding those who are not yet of that age whenever the change happens. If it were this year it would be 1980.
I support enforcement and see its lack as bad for the 3rd World as well. Remittances are now mostly spent on consumption not production assets. Join our efforts to Secure America's Borders and End Illegal Immigration by Joining ALIPAC's E-Mail Alerts network (CLICK HERE)

We will probably see the length of time in which to settle their affairs extended. The receptivity will also go up if there are more raids and flash deportations or jail sentences. I am aware that the major organizations want to have half the illegals out by 2012 and declining total numbers
as a realistic goal. I find that to be a totally realistic and highly desirable objecive shared with many Mexican nationalists those who want Mexico to develop not corrupt businesses and Mexican American politicians to gain control of the United States.
