One pleads guilty in Mandan rape case

One man has pleaded guilty to gross sexual imposition in the rape of a 14-year-old Mandan girl, while his co-defendant has maintained his not-guilty plea.

Angel Loria-Tamayo, 22, pleaded guilty Monday to gross sexual imposition. Loria-Tamayo was charged with a Class AA felony in connection with the May 26 incident.

Loria-Tamayo will be sentenced following a presentence investigation. He could face up to life in prison.

Loria-Tamayo is an illegal immigrant from Mexico, according to Mandan police.

Estanislado Jilpas-Tamez, 18, chose to maintain his not guilty plea to the Class A felony gross sexual imposition charge. South Central District Judge David Reich ordered that a trial in the case be scheduled for Oct. 12 and 13.

Jilpas-Tamez is a legal citizen from Illinois, police said.

Jilpas-Tamez was only charged with a Class A felony rather than a Class AAfelony because he was only four years older than the alleged victim.

Police say that the two men used alcohol to lure the 14-year-old Mandan girl and two friends to the men's residence on the 700 block of Poplar Lane on May 26.

The girl told police that she went to the bathroom to get something out of her eye, and her friends were gone when she got back. She said the suspects dragged her into a bedroom when she tried to leave.

According to police, Loria-Tamayo had intercourse with the girl, and Jilpas-Tamez attempted to have intercourse with her.

The girl's friends returned and took her to the hospital, where it was determined that she had injuries consistent with having been sexually assaulted, police said.

Jilpas-Tamez and Loria-Tamayo both pleaded not guilty to the charges on July 10.

They are both being held in the Morton County Detention Center on $10,000 cash bond.
