Reported illegal alien accused of rape to stand trial in Washington County

A reported illegal alien was bound over for trial Thursday on charges stemming from the alleged first degree rape of a local 14-year-old girl.

Virgilio Larrea Toscano, 26, was bound over following a short preliminary hearing before Associate District Judge Curtis DeLapp. Toscano's formal arraignment is set for April 28.

According to police, on Feb. 22, the father of the girl reported that Toscano had been having sexual relations with his daughter. The man reportedly told police that the girl had admitted to him that she had sexual intercourse with a 26-year-old on four separate occasions in 2004.

When questioned by police, the girl reportedly said that while she was 13, she had relations with a man named "Mickey" in December 2004.

Reportedly, Toscano identified himself as the girl's boyfriend but said his name was not Mickey. According to reports, he said he goes by the fictitious names of Mickey and Miguel. Police say Toscano estimated that he had relations with the girl "maybe 20 times," and that this began when she was 13 and he was 25, the affidavit states.

Additionally, he reportedly said the girl had told him before that he could get into legal trouble for having sex with her. He said that despite this, he chose to engage in the activity with her.

Toscano remains in the Washington County Detention Center on $200,000 bond.
