Suspected illegal immigrant gets 25 years for rape

Likely to be deported after release from prison

    Capital Gazette Communications Published 01/06/11
A suspected illegal immigrant was sentenced Wednesday to 25 years in prison for raping a woman last summer as she walked in a quiet residential section of Eastport in Annapolis.

Upon his release, Angel G. Antonio-Chavarria will likely be deported to Guatemala, according to prosecutors.

The victim of the June 21 rape, a 25-year-old woman from Arnold, did not attend yesterday's hearing in county Circuit Court in Annapolis. A letter she wrote Judge Paul A. Hackner explaining how the crime
impacted her life was sealed in a court file.

"Clearly (the victim) was violated in every sense of the word," Assistant State's Attorney Sandra Howell said after deciding not to read the letter aloud in court.

Outside the courtroom, Howell and Assistant Public Defender Denis O'Connell declined to comment on the final sentence.

In court, Howell asked Hackner to sentence Antonio-Chavarria to life in prison. O'Connell asked for a sentence within state sentencing guidelines - between 12 and 20 years in this case.

Antonio-Chavarria pleaded guilty Oct. 28 to one count of first-degree rape. At the plea hearing, Howell recounted the assault in graphic detail.

Howell said the victim left a friend's house shortly before 2 a.m. June 21 and started walking to her car. While in the 900 block of Wells Avenue, a man grabbed her from behind and pushed her to the ground. On a driveway between two houses, he raped her, Howell said.

While the victim - who was drunk at the time of the assault - initially told police she was attacked by two white men with "Eastern European" accents, Howell said in October she believed Antonio-Chavarria acted alone.

Detectives tied Antonio-Chavarria to the rape after tracking the victim's stolen cell phone to his apartment on Ashton Court. There, detective found Antonio-Chavarria holding the phone.

DNA also linked Antonio-Chavarria to the rape.

Howell blasted Antonio-Chavarria yesterday for initially telling detectives the sex was consensual and that the victim gave him her cell phone. She noted that the victim did not know him, that she sustained serious injuries as a result of the attack and that she immediately ran to a nearby house to report what happened.

O'Connell blamed alcohol for his client's actions. He said Antonio-Chavarria had lived a hard life, dropping out of school at age 7 to work and later emigrating to the United States to find a better job. He added that Antonio-Chavarria's wife left him shortly after she joined him in America.

"I feel very bad about everything that happened," Antonio-Chavarria said Wednesday through an interpreter, as he wiped away tears. "I regret what I did. I did it because I was very drunk."

Hackner sentenced Antonio-Chavarria to life in prison, but ordered him to serve only 25 years behind bars. Upon his release, Antonio-Chavarria will be placed on five years supervised probation. He also must register as a sex offender.

Hackner also expects him to be deported upon his release.
